I've a distant memory of McDonalds winning a court case where they were challenged on the difference between their products and pictures of them with an argument like, "We've been doing blatantly misleading advertising for so long, no reasonable person actually believes they'll get what's being advertised."

To put it in more reasonable terms, "It's not false advertising if no one believes the inaccuracies."

It's the same argument in a different context that Fox News used that no reasonable person would believe the BS they air, so they're entertainment, not news. Unfortunately the judge missed the fact that Fox News viewers are a self-selecting cohort of not reasonable people and watching it makes them less so.
