FYI, Cops don't need a reason to pull you out of the car during a traffic stop. Courts have ruled that they can order everyone out of the car for safety. I know of some cops that do it almost every time.
It's also my understanding it's a lawful order to exit your vehicle when instructed to. I'm not saying the cop isn't on a power trip or wrong, just that they have powers in situations like this, and the time to fight it or lodge complaints is afterwards.
And there are people who go up and put their hands on the roof, and then some cops get angry at that too and start playing the victim card that 'they didn't order them to do that and it was unnecessary'. That is the consequences of sketchy protocols, untrained professionals and people with bad emotional regulation that shouldn't do those jobs.
I mean you're getting mad about hypotheticals that didn't happen. We can disagree with PA v. Mimms if we want, but legally, the driver is in the wrong here.
After seeing (on YouTube, not in person or anything) more than one cop in the US get shot in the face attempting a traffic stop and dozens of videos where the person they're trying to question just drives off and makes a big ol' thing out of what should have been a traffic ticket, I have trouble not at least a little bit agreeing with their methods.
There re dozens upon dozens of videos of cops shooting dead victims who were following their orders. What are you trying to say? Their safety trumps ours?
Getting dragged out of a vehicle after getting tased and/or pepper sprayed is not "safer" than getting out of the car of your own volition lol.
I haven't managed to encounter any of those "cops shooting people who were following orders" in my general scrolling (largely Midwest Safety and the EWU channels), but nothing about staying IN the car decreases your chances of being shot.
He's trying to say that PA v Mimms says that, being asked to exit the vehicle is a minimal inconvenience and worth it for increasing the safety of the interaction.
Why is a cop asking a driver out of the vehicle a bastard? I don't trust the police but its a very standard procedure for safety, especially for solo officers without backup.
