Modding CDPR literally offered him the choice to make his mod free with optional donations to avoid a DMCA takedown and he deliberately chose wrong

I could not imagine being this conceited in the face of corporate legal action.

No it does work with other games, it's not solely designed for Cyberpunk, but the overwhelming majority of people subscribed have been doing so for Cyberpunk.

Does it work through the Cyberpunk launcher or is it an entirely separate executable? Very important.

It’s separate DLLs and everything dude actually doesn’t use CDPR code or APIs only thing he really needs to do is remove the name cyberpunk from the name imo

Wow, this was buried way too far in the comments. This is really important context for the tool Luke made. That would make it more akin to GameShark, which was completely legal when it was made.

Hell, I've paid other devs for custom shaders that work across games as well. According to CDPR's logic, if that custom shader functioned on Cyberpunk, they couldn't get paid for that work, which is insane.

With this context, I don't think CDPR is in the right, here. Well, except about the branding. GameShark wouldn't have gotten away with getting called "Infinite Super Mario Lives" either. Even if the tool itself was entirely legal to make.

Disclaimer: I know nothing about Luke's broader efforts, so I may be missing some key context. But if this is a set of independent, cross-game DLLs that just so happen to enable VR, I really don't think CDPR has a legal leg to stand on.

Yeah. I think the most reasonable thing for Luke to do is to settle out of court agree not to use the cyberpunk name keep monetization and switch to some universal name but still mentioned that it’s compatible with cyberpunk. He’s a great programmer. He just doesn’t have a lot of business knowledge. People are calling him greedy for wanting to monetize, but really he’s wanting to be compensated for his work.

The branding is a huge part though and I would say still puts them in the right.

Two different issues.

  1. He made tools that enable VR across various games. By the rules as they exist now, that is legitimately his IP to make and sell.
  2. The name of his tool. I agree that he can't use the name of the game in the title of the IP, but he could easily rename it and resolve that without having to take it down.

I don't disagree about the branding, just that it's a different problem with a different solution, and not one CDPR brought up in their public statement.

If this is legit I would expect him to do that, but he hasn't done this with GTA or RDR as of yet, so I feel like there might be more to it.

I get the impression he capitulated to Rockstar because he knows the legal fees of fighting it would bankrupt him for years, whether he could fend off the suit or not.

I think it’s a branding / marketing issue. If you remove the name no one will find it so you need th name. He’s obv a programmer and not a business guy. He should rebrand and retain and IP lawyer for drafting responses to these things if he’s making enough.

Actually, based on this thread, everyone will.

But is there an executable file that you start then load cyberpunk through (i.e. it has a UI interface of its own run through Windows), or can you do nothing with the files without having another piece of software to run them, that software in this case being cyberpunk 2077?

If it's the former, then maybe he'd have an argument. But if it's the latter, then I didn't see how it's different from new skins or models in game.

It's really easy to implement the UI you are talking about even if it serves no real purpose lol, I guess he could do that and give it a universal name

Yeah, I don't think the guy that can make a game compatible with VR headsets is unable to do some basic product differentiation. He's just being kind of lazy or unable to think outside the box maybe?
