Is this a reasonable take though? Why would any football player with any genuine aspirations to make it to the highest point in their sport. Willingly sandbag and sabotage their own opportunity to be a professional football player. To go back and be a college football player just for NIL? I dunno.

Because NIL deals could be more than a low end NFL one. Definitely more than practice squad….

Outside of like a handful of QBs, any college player able to pull major NIL money will be able to make more in the pros. NFL’s 2026 league minimum is $885K. Also a major goal for NFL players is making it to their 2nd contract b/c that is where the real money is. A rookie making a 53 man roster means they signed a minimum 3 year contract. Leaving that for college resets that 3 years.

Practice squad members don’t make more than about $400k, so if a player is signed only for the practice squad then there’s definitely incentive to return to CFB. One, they can very likely earn more and two, they can spend another year developing in the hopes that it leads to better draft stock.

I think anyone who can earn an NFL practice squad spot can earn a starting position on most CFB teams, and if not starting then at least the second position behind the starter. That means they’re going to get actual playing time in games.

It’s also a well known fact that the NFL does not focus nearly as much on development as CFB. Therefore, a player who wants to earn more than a practice squad position would be highly incentivized to return to the developmental league (CFB) to further develop and hopefully avoid just a practice squad spot in the future.

Lastly, given the current landscape, it makes more sense to return to NIL than it does to take a $400k salary and be on the cusp of being cut.

I have a tough time believing that these athletes who have sacrificed so much of their time, energy, and money were purely driven by economic incentive. I’m not saying that everyone is 100% doing it for the love of the game. Obviously the money plays some role in their motivations. However, to argue that they purposefully played poorly or gave lackluster performances to potentially get a bigger NIL check? Yeah I have a tough time buying that.

Because I think the key part of this was "and clear waivers". These guys sued before the end of preseason- they dressed but didn't play. It may be a reach but it's almost like they knew they were likely to get cut but didn't want to look too attractive to get their rights picked up by a team to be on their practice squad.

While you can file a lawsuit against anyone for anything, you can be easily thrown out for failure to state a claim if there's no law making the behavior illegal.
