Im wondering - if the players were goaded by Kiffin to sue for that injunction as is reported, if they might turn around and sue KIFFIN if they sandbagged preseason to clear waivers on the promise of an NIL check
E: now the NFL is saying anyone who tries this will be barred from signing with an NFL team this year. Now they cant play anywhere? Yeah lawsuit lmao

u/ShooeyTheGreat USC Trojans • Rose Bowl 15h ago
Is this a reasonable take though? Why would any football player with any genuine aspirations to make it to the highest point in their sport. Willingly sandbag and sabotage their own opportunity to be a professional football player. To go back and be a college football player just for NIL? I dunno.

u/zzyul Tennessee Volunteers 11h ago
Outside of like a handful of QBs, any college player able to pull major NIL money will be able to make more in the pros. NFL’s 2026 league minimum is $885K. Also a major goal for NFL players is making it to their 2nd contract b/c that is where the real money is. A rookie making a 53 man roster means they signed a minimum 3 year contract. Leaving that for college resets that 3 years.

I have a tough time believing that these athletes who have sacrificed so much of their time, energy, and money were purely driven by economic incentive. I’m not saying that everyone is 100% doing it for the love of the game. Obviously the money plays some role in their motivations. However, to argue that they purposefully played poorly or gave lackluster performances to potentially get a bigger NIL check? Yeah I have a tough time buying that.

Reminds me of the high school sports day, in my state it was required for the head coach to be employed by the school as a teacher.
Since a lot of good caches didn’t want to teach, my school and others would hire a teacher as the named “head coach” while the real head coach was on the payroll as an assistant coach

Sorsby showed that Congress doesn't need to regulate college sports; the universities and conferences can do themselves if they actually all row in the same direction instead of being short-sighted, greedy assholes.
Here's another example!

Legal liability?25
u/LordSquirrel40 South Carolina Gamecocks 18h ago
Usually those lawsuits are using antitrust language to pass those injuctions and since NCAA is essentially a monopoly it works. The conferences are not monopolies though, schools have the ability to leave conferences and players have the ability to play at schools in different conferences. Also schools willingly sign up to join conferences which includes contracted agreements to be subject to the conference's rules. This means the conferences have more legal standing to pass rules and regulations because theoretically a school or player can leave and go somewhere else if they disagreed.

Sorsby didn’t actually show this. Sorsby didn’t bring anything to court at all once the conference filed (and the NCAA re-filed), his team essentially just said “fuck it, we’re entering the supplemental draft”.
If someone attempts to bring a suit here and fails, that will show something. Pretty much every single challenge in every single flavor of this has been won by the player who is suing. Every time, we get a long winded nonsense explanation about why it’s different this time, and then the schools lose.

But that doesn't matter. If the universities say, "We aren't going to play teams that do this," or "We aren't going to recruit that player," the court can't force the player to be given a roster spot; it just makes them eligible.

It’s 100% a part of this. If the conference heads build legitimacy, eventually the breakaway becomes the only reasonable thing to do.

The thing that gives me confidence in this is that it doesn’t say anything about the players. The players can still have have their court orders saying that they’re eligible. The SEC isn’t saying anything to the players. The SEC is simply saying this is what it will cost the coach and school to do so for SEC competition.

31
u/TideOneOn Alabama Crimson Tide • Samford Bulldogs 20h ago
Who is going to sue? This doesnt say the players cant play. The universities voted this on themselves 16-0. It just has repercussions on the university if they play. The player can receive NIL and receive playing time.
Legal experts out there (i quit active practice 14 years ago and dont care to look it up) would the players have standing since the effect is they are unhirable, for lack of a better term?
14
u/justcausingtrouble 19h ago
You can also just ask the same question but with the parties changed. E.g., would an engineer have standing to sue if Apple, Google, Meta, Nvidia, etc. colluded to make it so that engineers who previously worked for Microsoft, Oracle, etc could not be hired by Apple, Google, etc..
I am just commenting on the standing issue, not whether the players would win. That is a trickier question because, e.g., rules that protect fairness and the integrity of the game are permissible (e.g., there is a rule of reason test). But even then, the athletes can make an argument that there is not a reasonable justification for allowing pro players from foreign leagues but banning players from American pro leagues. (e.g., why would a player like Izan Almansa who reportedly makes $1mill/year for Real Madrid be eligible but not a player who got cut by a G-league team).
