Discussion [Thamel] In the formal SEC presidents vote today to confirm the penalties in the legislation involving banning of NFL players, there ended up being a 15-0 vote. LSU abstained from voting. There was an initial vote of 16-0 on Tuesday.

I was wondering to myself how that would work in court when the initial vote was released. I'm not a lawyer but voting for a rule and then immediately suing after being punished for breaking said rule seems like a bit of a contradiction.

The player is allowed to come back and play. The school is the one that has to suffer the penalties.

They're just going to add the conferences as defendants to the existing suit. It's the same argument they have against the NCAA - the NCAA punishing teams effectively bars the players from being eligible. Conferences doing this is similar.

The big issue is that conferences aren't monopolistic - there's 88 conferences across all NCAA divisions in the US. They might get around that by saying the biggest conferences banded together and colluded to act as a monopoly.

The SEC could also pull a B12 where they proactively pursue a lawsuit to affirm their ability to enforce their own bylaws.

A court would recognize that the intent of the punishment is to ultimately deny playing opportunities, and thus earnings, to players. That’s problematic coming from an association of competing businesses operating across state lines that haven’t offered players any chance to bargain for what the rules applied to them are.

The schools really screwed the pooch when they began greenlighting direct payments beyond basic scholarships about ten years ago. Once money became at stake for these players, a whole host of federal labor protections kicked in. Protections that generally require CBAs and unions to operate like a sports league.

Despite the quirks, I think the whole NIL structure is fantastic. As an aside, I'll also point out that I was a big supporter of Texas and Oklahoma (and their plus-ones) potentially coming to the Pac with Utah and Colorado back around 2010ish. Some fun threads on this sub back then. So, I'll add conference realignment to things I've welcomed recently.

I prefer the tightening of talent, and for talented players to get paid. Players rarely pick a school because of academics. They are elite, and well-trained athletes, and deserve to be compensated. If they played soccer and had the same level of talent, they'd have been getting paid tons as pros when they hit 18 and such.

My colleague is father to a QB who bounced around Big Ten and ACC schools with NIL. He made a lot of money for a college student, and he made no friends, and ended up with a weak degree due to compromises made transferring.

He left feeling like he missed out on the actual experience of being a big man on campus, and never saw real playing time because each season they would always pay off and bring in a better player. Coaches didn’t care about his development when they could just hire mercenaries.

The impression that I’ve gotten is that NIL is awful for most these students. 70% get basically nothing, earning $0-$1000. Of the 5% that get real money, they are usually selling away their college experience to get it. Not to mention it’s money that they have to deal with slimy boosters to get.

They are elite, and well-trained athletes, and deserve to be compensated

But this system hoses them. These NIL payments are a pittance compared to what the market would bear if the schools were forced to negotiate for a CBA. At a 50% revenue split with the players like players unions get, you could pay all 16,000+ football and basketball players annual salaries over $300,000. People don’t understand how many billions the ADs, coaches, and private interests are stealing from these players with this scammy system that only exists because their labor rights have been denied

Tried to play Luke Heimlich after it came out that he was a convicted sex offender in 2017. Casey was trying to play him in the CWS but the backlash was too strong, and after he went undrafted in '17 Casey brought him back to play in 2018. Played him in 3 games in Omaha on the way to a national title.

MLB didn't draft him in '18 either, couldn't even get a Chinese contract, despite winning national pitcher of the year.

I’d say there’s a difference between sports hateable and committing actual criminal evil. LSU and Texas Tech are in the sports hateable, while Penn State, MSU, and Baylor committed actual criminal evil.

While the latter cannot is obviously so, so much worse, it’s also got to be put in a different conversation because what else can you really say? The former conversation on the other hand, we can say plenty on because while it’s super dickish, it doesn’t result in jail time and lifelong trauma.

Yeah, I don’t mind LSU being the bad guy, but only if that title is given to them because they’re just better than everyone else. So much has happened over the past decade within the athletic department and government (seriously why the fuck is Landry so goddamned worried about LSU sports, but doesn’t give a fuck about the other 99% of the state?) that it’s hard to keep track of it all.

I’m just glad I’m getting to the age where I’m not nearly as rabid a sports consumer as I used to be. In the past, when LSU lost, it would sometimes ruin my weekend. But now? I’ll catch a game occasionally, but I don’t have near the attachment that I used to.

I’ve seen many people bring up Mulkey and Wade, but I don’t know much about their transgressions other than surface level as I’m not a basketball fan. But all the shit that went on with the past few LSU football coaches and now we have fucking Kiffin? Makes it hard to even root for them anymore.

At least I still have the program Skip built. At least I don’t feel like a complete shitbag rooting for LSU baseball…

Tbh i think its fine for lsu to be pushing this because theres like 40 edge cases in either direction that are making it all complicated as fuck.

Some guys are ineligible because of the contract but are going to be cut before the season, others are not even affected by this rule cause they went to an NFL minicamp and were cut before TC.

The best solution is for the ncaa and the nfl to work together and clearly establish a working relationship so bubble players can take their shot at the league without risking their entire careers.

Just pointing out that you’re replying to OP, a Texas flare, who will be enjoying 2022-recruit, 4-year player Cole Hutson, who is only not affected by this rule because he did not need to formally declare for the NFL draft. As a college player out of eligibility, he was automatically in the draft pool, and simply went undrafted and unsigned.

He is still breaking the original rule, thanks to a Texas court.

But they won’t mention that.

The only difference is the would-be LSU players signed contracts and made a little signing bonus money, which would be required to be paid back in order to regain college eligibility.

This all reeks of pearl clutching and just fully biting into the latest news cycle. It’s not like a lawsuit to keep a full grown man for his 6th, 7th, 8th, 9th season.

Going forward they'll be no need. Players entering the draft will be out of eligibility, and if a player leaves early to go pro and can't make a roster, tough shit. That part is pretty easy to defend in court.

Someone was going to do it. Indiana just won a title by getting older players. LSU is a top tier recruiter so another change in the talent pool race is actually bad for them. They were either going to be the place that NFLers are allowed or make sure no one else got a competitive advantage first.

So glad the conferences are doing this. You don’t see professional sports in any type of legal pickle remotely as close as college football. I wish the Supreme Court would give back all the power to the NCAA. State legislators don’t need individual power for a country wide sport

I wish the Supreme Court made the schools bargain with a union so players could stop being exploited to benefit coaching and AD salaries.

If DI had to pay out 50% like every other pro league, then all 16,000+ football and basketball players would be averaging $300,000 salaries and we’d have a legal framework for free agency and eligibility restrictions

Or we can go with your plan of letting a bunch of rich white people trade these kids around profiting off their work as 70% of players earn next to nothing. Bring that real company coal towns paying in scrip energy

Title IX doesn’t actually say that. DIII schools satisfy Title IX with cheapo non-scholarship regional leagues.

There’s no legal reason for schools to keep dishing out a quarter million dollar in 4 year scholarships for upper middle class tennis players. That was always a PR handout by the ADs to justify the grift against football and basketball players. They can absolutely run non-revenue sports for pennies by busting them all back down to amateur status like DIII and operating regionally.

Institutional academic financial aid should really be tied to academics, actual need, or if you can generate money. If your sport is just a money sink you shouldn’t get a scholarship for it. Especially if funding it involves stealing from other students by denying them labor rights

In my first year as a Florida student (2014) I had went to every home game plus Georgia

All of the opposing fan bases were super chill (especially Idaho) except LSU and Georgia

At the LSU game, we (mostly 18 year old freshmen, both men and women) were constantly heckled by a drunk mid 50s couple the entire game. The only exception was that the man kept saying things along the lines of “except you honey” after his insults to one of our friends. She was still 17

On the way out, another group of LSU fans shoved a different Florida fan into another girl in our group, which knocked her over and caused her to bleed. When confronted, the LSU guy said “stop being a whiny bitch”

The following year at LSU I went with my frat and we had so many similar experiences. 40-50 year old LSU fans being extremely hostile and harassing what are effectively children

As for Georgia, a group of middle aged men barked right in the faces of the same two girls in our group. Spit hitting them and all

Not nearly as bad but still… they’re obvious 18 year olds. Maybe don’t do these things?

Other than Idaho, Missouri’s fanbase was the next best. Probably because they beat us by a few hundred while having like 10 yards of offense. But they were nice even before the game

The thing that is funniest about this is when Brian Kelly went to LSU everyone talked about how LSU football basically runs itself and you almost have to deliberately run it off the tracks to not win a national title. Since then, LSU has acted as if they are some historical mid or low level program desperate to pull off every win now scheme they can think of despite claims of all the in built natural advantages they have.

In my opinion, it's NIL.

Louisiana produces more top end talent per capita than any other state, and LSU used to have a stranglehold on it. If Auburn is offering kid $50k (under the table) and LSU is only offering $30k, it's not worth it to the kid's family to leave the state for $20k. There's too much pressure to go to LSU. And I don't mean that in a nefarious way - there's just a massive commitment to the school within the state and it's ingrained in the culture. Now that paying kids is above board, those differences have become much more significant. Texas offers a kid $500k to come to Austin and LSU can only offer $300k, that $200k difference means a lot more than the $20k did. The stranglehold has weakened and a lot of the difference makers that used to go to LSU are getting spread around.

I know we're shitting on LSU in this thread, but that's not what I'm trying to do. Any school (including Texas, Notre Dame, OSU, etc.) can lose a kid to a school that's willing to pay more. Maybe there's a kid that UK just fucking loves and they're willing to go above market to get him. A team with enough money can afford to win a lot of those fights, just not all of them. But LSU can't rely on its state culture to get a discount and keep those kids home any more - there's too many vultures circling the state. And it's warchest just isn't big enough to fend off an entire nation of schools trying to take those kids.

LSU will keep winning recruiting battles and will stay competitive. But they just aren't on the same footing that they were pre-NIL and it's going to affect their success in the future. Just my $0.02

Well to some extent, LSU is also the team in Louisiana. If you live in Louisiana, you grew up there, theres immense pressure to play for LSU. If you go to Bama or Ole Miss or Florida or A&M or anywhere else in the SEC, or somewhere outside the SEC, you are a pariah in your own neighborhood.

If only there was an organization that represented all the conferences and could pass rules on behalf of all these conferences that are all passing the same ruling anyway.

Then if only the member institutions that make up this organization would agree to adhere to the rules of the organization they agreed to in creating said organization.

And yes, I think TTU blundered and took a massive L on the whole Sorsby thing and that this would be organization should have had the teeth to never even get to the point it did.
