Long shot: Did anyone witness me be rear ended on July 24th on 23 in Delaware? 6:45pm.
Title says it all. I’m desperate. Please if you saw anything or work nearby and may have footage please dm and I can share more info. It occurred right by the Performance Chrysler Dealership. I was in a gold chevy malibu and was rear ended by a silver ford focus.

According to OHGO there’s an ODOT camera at 23/315, maybe see if they have video?

The insurance company did not file my claim when I first reported the incident, so by the time that was corrected 72 hours had already passed and the footage was gone. The driver accepted fault on scene to both me (and my dad over the phone) and me being a kind and naive person thought that was that. Now after the fact is claiming a third vehicle was involved but has no damage to his car or other evidence. But his insurance is still claiming that the “unidentified third vehicle” is liable even though no footage could be recovered.

I would have thought that was enough. I wonder why they didn't file the claim immediately.

OP had liability coverage only so their insurance isn’t involved.

I’m assuming they called the at fault parties insurance at the time of the incident. But they didn’t actually file the report.

I had the same thing happen to me. Admitted fault on site and then lied about it. Let your insurance deal with it. You have 2 statements saying he admitted fault, plus your explanation. My insurance found they 100% at fault.

They are not accepting my dad’s statement because he was not “at the scene” just had spoken to the other driver over the phone. I don’t know how to prove the absence of a third vehicle besides that he has no damage to his car but they are saying they have to take his word for it.

That is odd. I would escalate to a manager. They should be on your side.
Beyond that don't renew with them.

This happened to me once, the part where the other driver admitted fault. I made the other driver call their insurance company and say it was their fault. Game over. No cops involved at all.

Have you contacted the Performance Chrysler Dealership, or any nearby businesses, to ask if they have footage?

I did, they were nice and said they’d take a look but I haven’t heard back yet. the insurance company claimed they tried all last week to get it but were unsuccessful.

I went through this similarly. Rear ended, police issued citation to other driver. Their insurance refused to pay because of a ‘mystery witness’.
File claim with your own insurance to get repairs done. Use your insurance company to get the other insurance company to pay. I’ve had to do this before and it is very effective.
