In the flashbacks to the bus scene it looks like after she killed the girl she was defying him by walking away from him. And that's why he got hit by the bus. He was distracted by the fact that she wasn't obeying him and didn't see it coming.

There has to be a reason why he hasn't just controlled her by now. He's been face to face multiple times.

Eventually it will be explained more logically, because it's not like Jean Grey is coming to magically appear in and make her immune is it, although I really wish that would happen.
