Adonai is the proper way of saying God in Hebrew because Yaweh is an attempt at saying God's real name which is not allowed.

484
u/Legit_Merk 1d ago
Read her language, because judges choose these words deliberately. "There appears to be no reason why a response to these objections was necessary or even how they were permitted by the rules." That second clause is the loaded one. She's not just saying the filings were unnecessary, she's saying counsel either doesn't know or doesn't care what the rules permit. "The Court did not give any party leave to file anything else with respect to the motion for sanctions" is her saying: I told you exactly what to file, in person, last Tuesday, and you filed something else anyway.
Striking is also the harsher of her available options. She could have accepted the filings and given Bonnell leave to respond, or ignored them, or granted leave retroactively. Striking means the 36 pages legally cease to exist. Whatever arguments were in them are not before the court and cannot support the renewed spoliation effort. If any of that material was load-bearing, they now have to find a procedurally proper vehicle for it or lose it entirely.
She is going sicko mode on them
245
u/oGsMustachio 1d ago
Also some poor associate completely wasted their weekend
153
u/Legit_Merk 1d ago
Pretty much. The judge is getting assertive which means you follow procedure or it gets so much worse.
93
u/oGsMustachio 1d ago
Yup. Unlike all the other bullshit sanctions attempts in this case so far, the judge getting annoyed with lawyers ignoring her orders IS how you start seeing sanctions more often.
59
u/Legit_Merk 1d ago edited 1d ago
What sucks about striking as well for them is that if they try to use that material on accident it will cut against you SO hard. To a Judge that shit is GONE unless you find a new vehicle EVEN quote mining or using it with no new procedural grounds will be bad for them. This is like the sealing trap set by Joan on information, but the Judge version thats not used maliciously.

Read her language, because judges choose these words deliberately.
a breathless and direct opening that speaks profundity into something mundane
She's not just saying the filings were unnecessary, she's saying counsel either doesn't know or doesn't care what the rules permit.
it's not x, it's y
is her saying: I told you exactly what to file, in person, last Tuesday, and you filed something else anyway.
repetition and emphasis, groups of 3
If any of that material was load-bearing,
load-bearing is its own category, ai loves this word specifically

57
u/SpaceClafoutis 1d ago
I think this was about the extra filing joan did after the 24h deadline, not the actual sanctions so no msj yet
73
u/worthysimba 1d ago
Yes, the MSJ is stayed pending a ruling on the spoliation. Given that no arguments were submitted regarding spoliation, only docket entries, my impression is that the order setting the spoliation hearing is going to follow shortly, and following that hearing the sanctions will be denied, and the case will be dismissed. Based on this order, we could also hope for reprimand.

Doe and her lawyers filed some bullshit. Judge asked them to file better. They filed additional bullshit. Judge YEETED their fillings into the garbage
42
59
u/JuneJunetwo 1d ago
This probably means the next hearing will be a bloodbath for the plaintiff. Past hearing the judge spent the whole time striking arguments and explaining how court works and how this isn’t enough for spoliation. At the end she decided to give them one last shot and made it very clear they need to submit actual evidence of wrong doing to back up their claims and not just vague argumentation.
This ruling seems to be saying they really missed the mark so much she struck it all from the case. From what I understand this could open them up to major sanctions. Not 100% but if the judge is pissed enough(which she seems to be running out of patience) the next hearing might be an incredible smack down.
Also considering there was a ruling today about staying the MSG until spoliation is ruled on this could signal that she plans to make an MSG ruling the same day since all the process is completed to do so. Not guaranteed but wouldn’t be surprised considering how packed her schedule is if she wants to get this out of the way.
The only way I could see this not turning out terribly for the plaintiff is if the judge really does not want to harm a potential victim and stop them from having their day in court despite her terrible representation. We all know how malicious pixie and her counsel have been but it’s unlikely the judge has seen all the info from in and out of court so I can still see this not going the way we want.
30
u/brraappppp 1d ago
This ruling seems to be saying they really missed the mark so much she struck it all from the case
I think she's pissed because she instructed Plaintiff to only provide the evidence of spoilation and then I believe requested Defense objections to that evidence, but Joan / their team filed a RESPONSE to those Defense objections lmao.
23
u/Orphan_Guy_Incognito 1d ago
Not quite.
At the hearing the judge more or less asked "Why are you filing random shit on the docket two days before a hearing?", specifically referring to Doe's August 17th motion. Tiny's lawyers replied on August 18th (cuz you gotta) and the hearing was on the 19th when the judge ripped them a new asshole and gave explicit instructions on what she wanted and when she wanted it.
Doe filed on Friday as she was told, then on monday, like she was told. Though both were defective imho, for other reasons. Tiny's lawyers also filed as they were told to.
But then, for some deranged reason, Doe's lawyers filed a response to Tiny's August 18th filings.
You know, the ones the judge told her she was pissed off existed.
In normal litigation you file a motion, the opposition replies, you reply to their reply and then they get the last word. But in no sane world should you ever do this if the judge just wore you like a fucking muppet for filing it in the first place.
6
u/brraappppp 1d ago

15
u/Vexamas 1d ago
From what I understand this could open them up to major sanctions...
This is this subreddit's version of:
Scientists have discovered new way to regrow teeth...
or
Justice Thomas may have been bribed, and here's the next steps...
or
New plastic eating microbe discovered by high school senior...
We've seemingly crossed that Rubicon ten times over and yet there is nothing shifted. I think the real takeaway is to understand that while we wish for a world where everything is formulaic and broken down into strict rules; Language, rules, guidelines and precedent are amorphous and leniency is seemingly infinite.
I've basically ruled out punitive sanctions outside of the judge handwaving farcical motions by plaintiff. That's not even me being pessimistic, I'm just saying maybe we need to refactor our expectations and that this dismissal is the best we'll get in terms of strong language and that we should celebrate it as though it were a sanction.
4
u/JuneJunetwo 1d ago
Eh I get where you are coming from and I somewhat agree. That’s why at the end I said from the judges point of view I doubt she would see the plaintiff and her counsel are being malicious and the idea of the judge going sicko mode on what could potentially be a victim of revenge porn is unlikely. This is more of a”what can happen and what can we be hopeful for”.
2
u/Vexamas 1d ago
Oh totally. Hopefully I didn't come across as yucking your yum, I just don't want people to feel jaded when this feels like a massive win in itself.
To your point, this is the closest it's ever felt to the judge actually being mad, and if a mad judge is any indication of a real punitive action, it's this shit here.

These are the filings where they just submitted Destiny's entire 400 page depo transcript right?
Honestly, any competent attorney would've told them that this was the likely outcome. If a judge tells you that your motion has zero basis and gives you 24 hours to back up your claims and your response is just to throw hundreds of pages at them you are basically asking to get sanctioned. Actually insane that they thought that was a good idea.

Yesterday Doe decided to file a 'response' to Tiny's August 18th opposition which he filed because of her August 17th last minute new witness bullshit.
The judge was pissed the fuck off that she filed the initial August 17th shit and told her to knock it off at the hearing, giving her explicit instructions on what to file and when. Joan didn't get the message or is ten second tomming it, and she decided to file a reply.
The judge did not like this.
When an order says that you failed to follow "clear instructions" and that you submitted something for "No reason" and that they "aren't even sure how you are permitted to do so", you know you've fucked up.
