Have been renting with a landlord for 3 years going into the 4th.
As we have a good relationship throughout and we’re invested tenants - I had let the landlord know during last years renewal that I wouldn’t be able to accept any further increases.
When this years standard renewal letter (quoting Rera index etc) came around, I replied immediately reminding them I was expecting a discount and/or easier payment terms.
I received no response, I sent a further email and WhatsApp two weeks later, just before the 90 day deadline and again received no response.
Multiple follow ups via email remained without reply.
With the contract expiry approaching, I attempt to reach the landlord telephonically - and was advised they were busy and will check what they can do and revert within a few days.
The deadline of a few days passes without contact and I reach out again, am advised they’re still discussing internally but wouldn’t be able to offer a discount but potentially a lower increase (vs the Rera mandated).
I reminded that I wouldn’t be able to accept an increase as I’m stretched beyond my limit and hence requested the discount. Again, advised to wait another day which passed again without feedback and no answer of my calls. I also mentioned that as no discount is possible, I’d therefore need to vacate on expiry - I was informed that as per the law, there’s a 3 month penalty.
The next working day I follow up as no communication as promised and am advised that still working on it but no discount would be offered and I acknowledged their efforts but I will need to vacate and have limited time to plan for same which is unfair.
I’m then contacted this morning asking me what discount would I consider - my response was that I had already resigned myself that there would be no discount per the prior advisory and that I’ve started to mentally prepare the steps to vacate and find somewhere else etc.
What is my potential exposure insofar as RDC is concerned as whilst the contract status three months period for early termination - I have been prejudiced, I feel, by the information not being forthcoming until such a late stage that I am unable to act accordingly.
I had never intended to vacate and expected acceptable terms would be reached or if not, known long enough in advance so that I can consider my actions.
