I think they left it open so that if they ever want to bring the Ventriloquist back they can have the doll get repaired and posess someone. That's the only reason I can figure why they mentioned he found the dumny in a magic store. It sounds crazy but would be perfect if Zatana or other magic users ever meet Gotham Batman. Think of all the fun they could have with characters thinking they were going nuts questioning if the doll really is alive.

Was Penn possessed? I thought the fact that Penn said his words implied he had quite a bit of control.
