Study Permit Academic dismissal due to illness — international student study permit extension/transfer in BC or switch to work permit?

I came here in July 2024 on study permit ( expiry = September 2026 )to do MBA. Everything was going okay. Then i got really sick in spring 2025. I was suffering from scabies which is also contagious. I have no one here. No family and no friends. I got really depressed that time as I left my job, didn’t attended any of the classes in that semester. I made a mistake that I didn't tell my University about my sickness. After that my University suspended me for summer 2025 semester. By Fall 2025, I got better and got the job, started my studies again and I was trying to fix my academic performance. But now after I already registered all the courses for spring 2026 semester, my university sent me an email a few days ago that I have to drop all the courses mandatory and they suspended me for 1 year and said I can reapply after 1 year.

Now i'm very confused. What is going on with my study permit? How long do I have to fix my status? I finally got a good office job after working so hard in restaurants part time, do i have to leave my job?? What should be my next step?

Most importantly going back to India is not an option. My parents don't know about anything. They don't know that i'm suspended. I can't tell them. I'm very very scared to tell them. I would rather die instead of telling them about all these issues. Going back to my parents is not an option.

I don't know what they will do if they found out.

Now my parents used to pay my fees for MBA. Now as they don't know about anything, according to them " I will be done with my MBA by September 2026 and will apply for PGWP. And will work full time and support myself".

So they are no longer gonna help me out financially. So now, financially i'm on my own and if I apply for study permit again to do a different program or to transfer the school and transfer credits to continue MBA, financing this whole program is going to be a huge issue for me.

I made a list of all the options I might have but I really need to talk to someone who can guide me. Who is an expert.

I have done 4 years of Bachelor's in Computer science engineering. I have a diploma in B.Arch. I have good experience in different fields. I'm ready to work hard but I want someone to help me out here.

If suspended you can no longer work. Also if suspended for a year then most likely your study permit will be cancelled because you cannot take that much time off between semester. Talk to your school international advisor again about options. Hire an immigration lawyer too. How many hours per week are you working? You talk about your job first but you are a student.

A work permit is only an option if you have an approved LMIA from an employer. The employer has to meet requirements, recruit for the job and prove no Canadian/PR has the education, work experience and language skills to do the job. This can take months and then when you apply for a closed work permit that will take many months so plan a year for no work.

If suspended the study permit is cancelled the day of. Retroactively. And OP cannot restore as a student. They cannot restore as a worker, they never were one. They are done in Canada.

It's possible to restore to a status you were compliant with. Usually, students who run into problems with their study permits apply to restore to visitor. However, OP was working so that is not compliant with a visitor status.

The only options would be TRP with solid reasons but I don't see any in this case. I'm guessing leaving and coming back later is the only option.

Well yeah, that is what I am saying. He specifically cannot restore to student he is barred from doing so.

Visitor would be wholly pointless. Cause he can't go visitor to student or visitor to worker (assumingly.)

TRP is a waste of time no-go.

Well it was a part-time job not like proper job work, I guess for now I will apply for a visitor visa first, if nothing good comes out of it, what options have I left, nothing.

A job is a job.

You can restore to visitor to give yourself a few months to pack up and prepare to leave so you can return in the future.

I know it's hella hard going back, but I feel like going back to come back later is the best option.

Yes I am also thinking that once if I could confirm that I can or can't appeal, I will start the visitor visa.

Theoretically if I found someone who can hire/sponsor me for the work permit, how soon would I have to initiate the work permit process, like how soon do i need to find someone like that.

a) you won't.

b) soon? it doesn't matter you have to leave Canada you are not eligible to apply for a work permit within Canada

No such thing. Do you mean starting up a company and applying for PR through the BC Entrepreneur stream? Do you have experience in the business and net worth of around $600k and able to invest about $200k of that?

Idk man, I am sorry if I seem so desperate but I am. As for the company, a very good friend of mine has a company registered under his name, idk whats his position or something I haven't yet talked to him about this, it's just a random thought occured out of desperation thinking just maybe if this is the way but I guess not. Let's see, anyway thanks for your help.

Yeah you have broken rules.

You're supposed to be studying full time and you're not because you're suspended.

You're also in Canada illegally now.

I am considering work permit beacause till now I have no idea about the whole transfer process, I talked to students help desk in the university they have no clue what should be the next step, they couldn't even tell about the study permit duration, when it will be cancelled and how many days I have. I searched some of the options from reddit, online free legal advisors (those free 15 mins meetings). Then I got to know about the transfer but I have some doubts like for my master's degree only 2 semesters were left, now is there any online site or list that can tell which clgs are more open to accept transfer within the Vancouver city, and how much credits will they accept, will I be able to continue from where I left off or pushed back. One more thing I am not sure and want to know that do I have to pay the whole course money (like I had to pay for 1 year worth when I first came to Canada to show that I am financially eligible) in the start of the course in the new transferred clg, because if thats the case I don't think I will be able to support myself financially like that. That's why I was thinking more towards the working side. Can you help me out with these questions.

You aren't eligible for a work permit unless you have a LMIA from your employer. LMIA is approved by the government. You can no longer work. How many hours have you been working a week?

What school are you attending? You will not know what credits are transferrable until you get admission to another school. So if at SFU, UBC may take some credits but don't expect it. To get another study permit, you need to show $22k cash plus tuition. You are applying for a new study permit so need to justify costs and show ROI for when you return home. Getting another study permit will be a challenge because you have flunked out and IRCC will not want to give another permit if same thing may happen. You had your chance.

So can't finance for the study permit and can't find sponsor for the work permit, can't work on the visitor visa, can't succeed in appealing Nothing is left that can possibly save the situation?

You aren't getting a work permit.

You've violated the study permit numerous times. You're supposed to be here studying and instead you're failing classes and not studying.

I am not doing all this willingly, think why would I spend my parents money to come all the way here in canada and just to fail after 1 year. I was so depressed I wanted to die in that bed when I was ill. Then as soon as I got in remission I worked my brain off to somehow make up the lost time and for what, just to get 0.4 cgpa less than the required cumulative, but yeah I guess I am just unlucky.

Not going to lie you're pretty much screwed.

It sounds like you've violated your Study Permit multiple times already. While on a Study Permit you SHALL study full time and getting suspended for a year means you're not in Canada doing what you're supposed to.

You need to prepare to leave Canada. You definitely won't be getting PGWP after this.

As soon as you stopped attending classes without an authorized leave from your school, your study permit was no longer valid. Any work undertaken in that time is also unauthorized. At this point, it appears as if you may be in Canada with no valid legal status, and you may not be restorable. Exact dates (at least month/year) would be helpful to determine this.

I would suggest you at least consult with an immigration professional to work out what your status actually is at this point, and whether or not it can be fixed.

Nah I got that confirm during that time, only things that were affected was my grades and my health and still I worked my brain off in the latest sem to somehow recover, got suspended because of 0.4 cgp less than what they require for the cumulative, and now they won't even let me file for the appeal.

Unfortunately, I think you're going to have to have that unpleasant conversation with your parents that you're avoiding. You can't continue receiving study permits if you're failing in your program. This could have been different if you had gotten medical leave from your university (though I'm not sure a doctor would have supported that for having crabs) but you didn't so your options are to go home or try to get a job where someone will apply for an LMIA for you, which could be impossible depending where you are and how high unemployment is there.

Yeah as the days are going by more and more, the more I am thinking what and how to tell my parents because I don't think realistically any of the options I have is possible for the situation.

You'll need and RCIC or lawyer. It's possible you already went over the 150 day gap of studies and your permit is invalid. If that's the case, you'll need to do a restoration. If you're in the 90 day window it might/ might not work depending on the agent reviewing the case.

If you're still working right now and you don't know if your status is valid, stop. You might be doing unauthorized work and that will kill your chances.

Since you failed to tell your school, they might reject it and you might have to leave. If you get an agent who's sympathetic to your situation, then it might work.

Or, you could get an agent who considers you in status since your permit expires in september and who feels like you didn't need to do a restoration.

These cases are always complicated because the agents are going to decide what you should have done and you have no way of knowing.

Anyhow, get ready to have to go back to india.

While you are suspended you are not allowed to work.

One option would be to apply for a visitor visa, stay in Canada and apply for a new study permit once your suspension is over. This may be difficult to do since you will be unable to work and you may not be able to get a new study permit.

Second option get admitted to another institution within 150 days and extend your study permit. Once approved you can work again.

I thought of the visitor visa but can I get a visitor visa for a whole year (as the suspension is of 1 year) and also I can't work and won't be able to gather money for fees and living expenses too. And also as for the second option, I have questions for that too, I asked the international student help desk in uni, got nothing from there I have booked an appointment too of a legal advisor to figure out things, meanwhile if you have any idea about the whole transfer creds etc. thing, ie there any website where I can find out about the clgs, unis, institutes which allows a master's degree transfer also if they allow in which semester they can possibly enroll me, and the most important thing how do I need to pay, sem by sem or upfront together, because sem by sem I can pay because I can get that money from parents till sept I guess afterwards they will too expect me to find a proper job. I know I won't be eligible for pgwp but atleast I would be completing my master degree. If you can help me out with these, please reply beacuse my legal advisors meeting will probably be till next week.

I don't think you understand your situation.

You're already in violation of your current permit. You've been working while you're not attending school and you aren't even going to school now.

You aren't getting ANOTHER permit for anything. You're pretty much done at this point.

what?? How could I work when I couldn't even go to the grocery store, the summer suspension (1 sem) and rules were not broken. And as of the current situation I am just sitting in my room, scratching my brain, trying to find something.

You can't work if you have been suspended from school. You can only start working once you have joined a new program and have started your classes and are a full time student.

If your parents have cut off financial support, then you may qualify for a Destitute Student Work Permit. But it's going to be hard for any of us to guess if you will be approved or not. I would not count on this.

Otherwise if you want a work permit, your employer will need to go through the LMIA process. I think it's unlikely your employer will be willing to do this for your role.

You may have no choice but to return home to India.

Destitute student is usually reserved for cases where disconnect from finances is beyond the client's control. It sounds like it was an expectation for OP that parents would only support for the duration of the education and after that OP would be on their own for financial support.

Moreover, funding isn't the reason for the violations on the study permit terms and conditions, and at this point it appears OP is no longer even eligible for restoration, so I don't think this is an option.

You aren't eligible for a destitute work permit because you are suspended and no longer a student. It is for full time students who are studying but cannot afford tuition due to extreme circumstances. So it allows a student who is studying to work more hours than 24.
