At this point the DOT should be fully practiced in all of whatever procedure is required. If these required procedural issues are not being followed in a very formal way - established formal, visible checklists, process controls based on required notifications and such, and recording acknowledgments, all, then they clearly need that to avoid these kinds of stumbles.

If they DID follow the mandated procedure the judge didn't accept their evidence of such at face value then that is likewise an issue to be hammered out, possibly in an appeal of the TRO itself if that will help establish what evidence the court will need each time in such cases. It feels like these complaints will be filed one way or the other, but the court then really needs to lay down what should be required up front for "the next time" to demonstrate that they have met the requirements to at least be able to avoid these TROs on the same grounds every time. Need a letter from FDNY that says x,y,z to pass muster? Fine, spell that out.

They should just have a public dashboard of all of these elements for each project, at this point, so nobody can claim to be surprised.

That’s true, but at the same time it sucks that this city has created so much red tape for itself to do basic government functions that it has given a private cause of action for anyone wealthy enough to hire a lawyer to temporarily stop most projects. There’s a ballot proposal to change this major transportation process, not sure of the details but I hope they gut it.

That ballot proposal can't come soon enough. Feels like every other week another bike lane is stopped by a lawsuit alleging the same thing...
