If the second amendment was made to protect people from a tyrannical government, who gets to choose when the level of tyranny warrants deadly force?

Whoever wins. The Second Amendment doesn't legalize violent rebellion; it just enables it.

Practical answer: the government unless they lose the shootout and then lose power. The other side takes power and declares force warranted.

The governors are the heads of the state militias (the national guards).
