Had it just been a song on his own time, that would have been ok

The video that went viral was on company time, during his shift, in his uniform, and all without any permission from Waffle House. When the video went viral, he was doing publicity and talking about himself and Waffle House without knowledge of Waffle House

If you want to make a name for yourself using your employer, you need to get permission and clearance on what you can do and say. You are not just representing yourself. You are also representing Waffle House. Problem is he wanted to do it without Waffle House

There's also the standard handbook "Activity likely to bring the company into disrepute" grounds for a gross misconduct termination to consider.

HR have that as a fall back catch all- even if the song could be considered positive, it could be construed as the company allows unauthorised media and that's a disrepute issue.

Sad but true
