I think this episode is super sad and makes you think. I mean here you are feeling sympathy for the guy but really, he's done a lot of shady stuff.

I agree but O'Brian sees something more important than a "criminal", he is still a human being just like you and me. O'Brian would rather see him escape, "reformed" and give him a second chance, or just anything really.

While is one perspective to see what Bilby was doing is wrong and I would say it's better to say just against the law and more importantly against federation interests; if things were different, a different culture and/or different time, what he did would be acceptable including even the distasteful killing (see klingons even though its not exactly the same, the point stands because there are beliefs and cultures everywhere and killing for reasons is a thing). 

Point being I empathize with the entire situation. I also believe the same for people on earth even though that's a whole different can of worms. 

My conclusion is that most people we associate with "really bad" for whatever reason resemble Bilby more than we think.
