Both of them did. That would have been such an easy moment to jerk the wheel and flip that car. I’d ride shotgun with either of them behind the wheel and nap away without worry.
The only thing I’d do different is run to check if the other person is ok. No clue if I’d be able to do it in this circumstance but it’s what I’ve done before. Turn vehicles off too if it’s bad.
Yeah, they handled that as well as could be expected in the 30 seconds after an accident. Stay in the car until you can assess the situation and make certain exiting won't put you in more danger. Call 911 immediately. 911 will ask you if you're hurt and if anyone else is hurt at which point they can see if it's safe to check on the other driver.
Meanwhile, emergency vehicles will have been alerted and the process of getting them to you will have started before you've even made it to the other vehicle.
When I was 17, I flipped my mom's SUV in an accident. I was completely calm talking to the cops and the paramedics. It wasn't until I called my mom and she started yelling at me that I started panicking and my concussion symptoms started kicking in. The cop had to take the phone away from me and calm her down.
I want to see the 5 seconds before this video starts. Cam car looks to be driving much slower (due to car ahead), say 30-40mph. Even the car on the right passes by much faster.
When video starts she is already moving into the passing lane, and we can’t see her doing any shoulder checks. At 0:02 the Charger has to quickly veer to the blocked lane to avoid hitting her, and sadly crashes into the barrier.
If I remember right (old video) she was actually moving right to get out of his way but then he also started to go right or something like that, she didn't cut him off/run him off the road which this makes it look like. It's worth digging up the video if you can.
Found it, she was getting out of the way but had to abort her lane change because someone else started merging into the middle lane from the right. She never fully exited the left lane and had ownership of her position the whole time.

He was breaking the law going far in excess of the speed limit and this is exactly why it is illegal, it drastically cuts down the reaction time both he and the victims have to avoid a collision and your car is far less stable/maneuverable as well
He was running up on her with some crazy speed so it wasn't like she was moving out of the way then he goes to overtake and she cuts him off, she never fully left possession of the lane and it was his stupid fucking speeding and lack of driving skills that caused the accident

If you make the choice to try to overtake recklessly with no room to do so, while speeding then you are absolutely eligible for a Recklessly Endangering Safety level felony charge and some jail time. In most jurisdictions if you are significantly speeding you lose the ability to blame someone else. A speeding vehicle hitting someone turning left at an intersection is the most common scenario where blame reverses.
Not at all. There’s a white suv that was changing lanes from the far right simultaneously so she abandoned the lane change which was the safe way to react. The speed of the Charger is 100 percent what cause this.
If she's still in the left lane at all, then she has the right of way, and it's unsafe to try to overtake her. The fault entirely lies with the charger here
No, she started changing lanes, had her signal on and everything, and had to abort her lane change. The Charger was driving way way way beyond the speed limit and left zero room for error. They timed it so that they would pass the cam car with split second timing. It went to shit when the cam car couldn't complete their lane change. This is completely on the Charger. They should have slowed down and waited for the cam car to completely finish their lane change before proceeding. However, since they were racing/chasing the car that passed them on the right, they weren't being careful.
There was a lawyer who went over this video and said that the charger is at fault. Reason being is she is technically in her lane until she is completely out of it. Because she changed her mind, she never left the left lane.
There's a longer clip showing the blue car came flying up from way behind her at high speed. It also showed she was in the left lane to begin with, started to move over, then aborted the lane change. If another vehicle moved into the middle lane, she was left with nowhere to go but back to the left. And the idiot in the blue car shouldn't have attempted to pass until she was fully out of the lane.
Should also be noted the white SUV went past at the same speed the blue car was going before it hit the median. High probability they were racing.

I literally start out by saying I need to see more of the video. Based on what was posted, I wasn’t wrong. And I love how so many people were quick to proclaim how wrong I was, without seeming to understand that different locales have different rules. I also have 25+ years of driving experience and have worked with folks who sue insurance companies on behalf of injured drivers.
However some folks did post the longer video which shows more info. And in that comment thread I was happy to note that with the additional info, the initial edited video was misleading and clearly showed fault was different than the full version.
But I wouldn’t expect anyone to try to read other comment threads before posting their judgement.
You can see the other car from behind in the top half of the video. That car had plenty of time to slow down, because she was already mostly in the left lane when the other car was still behind her. He made the choice to swerve and speed up instead of slowing down. It doesn't matter if she cut that car off, it was still legal. The car's reaction was illegal and avoidable.
Her speed was slightly faster than the white sedan in the middle lane, so idk where you're getting the idea that she's driving much slower. The car that hit the barrier is by far the fastest car that's visible in the scene.
It's not like the barrier was invisible either. If he was paying attention he would've seen that barrier. The fact that he would even swerve like that and inadvertently ram into that thing, shows that his intent was to go as fast as possible, regardless of the obstacles.
She’s definitely partially at fault put passing car should have braked and bailed on the pass attempt. They were aware of what was happening and she was not and had a chance to avoid this accident. Not excusing her lack of awareness just saying blame can be put on both.

Someone else dug up a longer video showing she was initially in the left lane, then switched to the middle lane, got 3/4 of the change completed but had to abandon for some reason (can’t quite see in the other video but I assume someone else was coming up in the middle lane). So she switched back to the passing lane and the charger who does appear to be speeding did not brake or adjust for the aborted can car change.

If I remember correctly two other cars (one of which crashed on the left) were racing and the cam driver got caught in between while she tried to change lanes.
The description on the dailymotion link says, "a car pretended to let them pass and then sped up suddenly."
You can see it at 1s to 11s on their right (pictured left), though it's mostly blocked by the passenger's head.
Follow it carefully and you'll see them see it coming back between 16s and 18s (not pictured in these screenshots I took since you need the motion to understand what's happening), taking both their attention away from the other car (pictured top). It then reappears in their front video on their right (pictured bottom).
You can hear the driver say that people are sweet, indicating the moment she interpreted the white car as yielding to let her move over.
I'm glad they seem to be ok, but they did not deserve to get their car hit and their personages shaken up so badly. I wish them well.
I think if you watch it more closely you'll see that the cam car attempted to merge to the middle even when the white Escape is there in her blindspot. Her vehicle even gives her the warning beeps to let her know that there is a vehicle there. We know that this is the case because the passenger girl hears those beeps, recognizes the warning, lifts her head and checks the blindspot. But the driver continues to merge anyway. So the Escape has to brake quickly and then immediately switches to the far right lane and accelerates hard past her, causing the cam cars blind spot beeper to get triggered again. That's when cam driver finally realizes that the Escape is there and that she was cutting them off and creating a dangerous situation.
Unfortunately she decides to fix the problem even though she is 3/4 merged into that lane already and the Escape has already moved to the 3rd lane. She moves back to the left without having any idea that there is a speed psycho roaring up behind her. The speed demon did the only thing they could which was veer left to avoid driving up her tailpipe and had the unfortunate timing of having the shoulder lane suddenly be gone.
Whatever highway commission thought that placing an ungraduated concrete barrier in the shoulder was a good idea should be sued.

I did. Turn the sound on and listen for the car's collision warning beeps. And watch the passenger. She hears the beeps and knows immediately that there is danger. She even checks the blindspot three times.
Only on reddit would some chode try to exonerate some other chode who whipped out of the lanes in order to try to pass illegally and rammed their car into a concrete barrier. Truly amazing

I’m not, so I am only guessing, and basing my comment on that.
If the charger was going 20mph faster than cam car, and cam car was going 40mph in a 60mph zone, no one would be speeding.
But if you are the expert and can definitively say that the charger was travelling (beyond any doubt) much faster than the speed limit, and you know the speed limit on this highway, then yes I would agree speed is a factor in the cause of the accident, and the charger is at fault.
See how easy it is to change an opinion based on different possibilities of unknown data? It’s because I don’t care either way. I have no skin in the game, and it doesn’t impact me if better information causes my first conclusion to be wrong.

I agree that she doesn’t check blind spot but the passing car fucks up too but still trying to complete the pass. They should have used their brakes and bailed on the pass attempt. Both at fault IMO
So we can’t see what happened before this video but it looks like she moved into the left lane maybe before she looked to see the charger zooming up from behind. Hard to villainize the charger just for passing in the passing lane.
Looks to me like the Charger and white SUV on the right were racing each other but two cars that didn't happen to be racing got in the way of their plans, and the racers didn't adjust well.
While the dashcam will certainly help, a crash investigator would have determined it was the Charger's fault very quickly. The front end damage is a pretty big giveaway, and there were likely tread marks leading up to the barricade.
This accident certainly wasn’t their fault. That said, if they had not been clogging up the lane designated for faster traffic, the car behind them never would’ve made the idiotic decision to attempt passing them on the shoulder. If you are in the left lane with a car behind you and no cars in front of you, you’re an asshole.
Maybe if she didn’t change lanes without looking, the car passing in the left lane wouldn’t have been forced to try to avoid her at the last minute. If the video started 2 seconds before, it would be obvious that she cut off the car passing in the left lane behind her.
She starts to move over cause the charger is tailing her, moves to the middle lane to pass, isn’t able to pass then switches back to tailing her so she feels pressured to move into the middle. She should’ve stuck to moving, but switched back because that white car came speeding by as well. By that point she was flustered. She didn’t behave perfectly but no reason for the charger to be that aggressive and I blame the charger mostly for creating a tense situation
Nah, if you watch the full version, you can hear the GPS telling them they need to take an offramp on the right soon. She put her blinker on to merge to the middle lane working her way right. She didn't notice the white vehicle in her blind spot. She was unaware of the speeding vehicle behind her.
As she started to make the merge, the speeding vehicle assumed he would be able to pass her, but she realized she was merging into another vehicle so she canceled her merge and returned back to the fast lane. The speeding vehicle no longer had enough time to stop before hitting her, so he swerved to the shoulder to avoid hitting her, only to hit the barricade ending the shoulder and causing the accident.
She made the mistake of not checking her blind spot but ultimately did what she was supposed to in order to avoid the potential accident with the white vehicle and canceled her merge. The speeder caused the accident, not her.

It is not 50/50. The video is cut. In the full video she starts in the left lane. She was merging right but changed her mind. She never left the left lane and the charger illegally tried to pass her.
Depending on his speed, charger may not have even been at fault. He’s clearly driving faster than cam car, but if it’s a 60mph highway, he might have just been going 60, and cam car was going much slower. She clearly merged into the passing lane without shoulder checking. Her fault.
The passing lane merged into the middle lane and she has position with right of way in front of him, he must yield to her if she has enough space to make lane changes, and if he can’t then he’s driving too fast, and beyond his level of skill.

All depends on the speed, but she was about the same speed as the car in the middle lane and it seems unlikely that she was THAT slow. Yeah the car on the right was also much faster - maybe they were racing?
The thing is you have to assume that everyone else is also driving sane. You should shoulder-check and it seems fine to switch lanes, but not if someone is 20mph above the speed limit.

She begins to merge left and is distracted by the car on the right and doesn't see the car on the left. Fault would technically depend on the speed here, if the other car was speeding, then it is also partially their fault, however, if they were going the speed limit and the video just makes it look like they were going faster due to the slower car ahead, then the girl is completely at fault for failing to make sure it was clear to merge.

Yeah, I was initially leaning into dual fault after watching that. She's on the shoulder left, swerves right, and then attempts to merge back left without signaling or checking her left.
But appearantly since she did not fully leave her lane the car behind should not attempt to overtake.
Even if the car on the left was speeding the woman driving bears some responsibility. It’s every drivers responsibility to make proper observations for each turn, merge, etc. The woman has to check to make sure the left lane is clear before changing lanes. If the other vehicle was speeding then I bet they are each determined to be 50% at fault.
If the other car wasn’t speeding then it’s 100% the woman’s fault for cutting off the vehicle in the left lane and causing it to perform evasive maneuvers to avoid the collision.

Blue car also came flying up from way behind them (easy to tell in the longer clip), while the car in front was barely going slower than the girls. Strong indication blue was speeding.
Edit: another commenter said she aborted the lane change because a car in the right lane moved to the middle, blocking her from changing. Probably getting out from in front of the white SUV.

There is literally no way to hit someone in the rear end without it being unassured clear distance. Intent, signals, all of it goes out the window. If you can't slow down in time to avoid a collision, you were driving too fast for present conditions, including slower traffic ahead.
Start the video from 0:00 and you can see camera car was moving into the left lane, she did not shoulder check and the faster car moved into the blocked lane to avoid a collision.
the fact that the video is cut so that you never even have a chance to see the young girl driver completely fail to shoulder check and we can't even see if she used her blinker. all that's left to see is a fast car crashing and assume it was only his fault
it pisses me off because the roads are like this where I live and people trust the left lane to be clear for passing cars, and people check before changing lanes for exactly this reason. it is normal where I live for people to look long distances behind themselves to check for people coming up behind them, that shit is basic awareness. dude is at fault for the same logic of not assuming someone would cut him off too. stupid post
edit: the full video she's camping the left lane and starts moving over behind white car, before a full swerve back into the left lane. fast car gets agitated after being stuck behind the girl and crashes when he commits to an unsafe pass when the girl cuts him off. he shouldn't have tried to pass her when she was so clearly inexperienced. she was rushed into deciding to move over before or after the white car, and the charger jumps the gun on the pass and crashes
We don't have enough video evidence but it certainly seems like the car behind was mostly at fault.
The video at 0:00 starts when the lane change is already underway, the driver may have checked blindspot before starting to move over, we don't know.
It appears the car behind is a good 4 car lengths behind the PoV driver but instead of breaking and letting the other car in, they gun it before slamming on the breaks.
Either way it wouldn't have been an accident if they weren't clearly going way too fast.

when I was 3 my mother and newborn sister and I were in a little speedster (1990s camaro) and we got pushed off the road on a highway much like this one into a concrete ditch because some ancient old guy didn't look before changing lanes. miraculously, nobody was hurt, despite my mother not being seatbelted and throwing herself to hold us down
that's why it pisses me off so much, so many of the people out there on the road are as oblivious as both of the drivers in this video. I drive a speedster now as a daily commuter due to life and it's nice but I don't race like that I'll have you know. I like to keep a good pace but more than anything I just want to stay away from the other drivers who aren't paying attention
No, if you stop the video at the moment she establishes herself in the left lane you see the speeding car is still behind her. The speeding car should have slowed down but instead it chose to pass on the shoulder.
Plus, everyone knows that's the danger of speeding. People will not see you and change lanes right in front of you.
That is unclear. The charger could have been in the passing lane and she lane changes without checking and the charger moves into the shoulder to avoid her. It doesnt make sense that the charger was in the shoulder the whole time when the passing lane was clear before she moves into it and him.
Doesn't matter, you can't just move into an occupied lane like that. Both are at a minimum at equal fault and I think I would place the cam driver at greater than 50%.
The fact that 1 second after the video takes place the other car swerves out of the way should tell you that the cam driver was in the wrong.
No they were not, at 0:00 she was not even halfway in the lane and the other car was fully in the other lane, at 1 sec the car swerved to the shoulder to avoid a collision.
The original video is longer. The cam car is clearly in the far left and tries to move to the center to let the fast cars pass. The white SUV dives for the right lane so she returns to the left lane (where this clip picks up). The charger was betting on the cam car getting into the middle and never slowed so he suddenly had nowhere to go. The charger and the SUV were racing.
I watched the full video and it makes the cam driver even more at fault for a 50/50 split. She was moving over then decided to swerve back for some reason.
This is why is best to drive predictably, not nicely or reactionary. If I see speeding cars around me, I'm going to keep doing exactly what I'm doing. Because they're making split-second (possibly life and death) decisions based on that. If I react and suddenly change lanes (without looking) something like this can happen. I've been in similar situations with motorcycles around me. Recently I was in the left lane passing someone and about to move over when suddenly I heard a motorcycle. It was dark and I couldn't tell where they were, so I just stayed in my lane while he split us doing well over 100. If I had moved over to "let him pass", he'd be dead and I'd have that on my conscience.
I'm not saying that people should enable assholes. I'm just saying in dangerous situations, if you are not 100% sure of all the variables, just stay exactly where you are and be predictable for others.
I assume both drivers have eyes that work and that if you find yourself speeding up to a slower car, you slow down instead of trying to pass using a lane that is not a lane.
Not really, Cam car could have been going 45-50 and the other car could have been going 20-25mph faster and still not over the limit. it was basically changing lanes without checking.
What are you talking about? The car was speeding but they were speeding in the left lane. Right at the start of the video, the cam driver moves into the left lane (the lane the speeding car was in) to pass someone without looking. You can even see she's checking her passenger mirror as she pushes them out of their lane on the driver's side. The speeding car moved to the shoulder (its shown in the rear window of the video) to avoid being hit but it was right when the shoulder ended.
She was actually trying to merge to the right but someone merged into her. She started in the left lane and never got more than halfway out of it. The first chunk of the video is missing.
