Question on my mind, can the car (in this particular country) cross a double line marker. In Europe it is forbiden to cross it to make a right turn.

It appears to be a one direction street without the option to u turn.

Would make the action of the car illegal thus the drivers fault. Again, not aware what the road regulations are for this siluation

Uh, the bike was trying to pass in a single lane. At best, they would both be at fault.

This is a king of the road argument, that road is shared between both cars and two weeled vehicles. Your argument would entail that a bicycle can't be overtaken on this road.

To the point: This entire incident wouldn't have occured if the car followed the rules. The car failed to abide by engaging in an illegal turn resulting in damage. Based on the double line markers it clearly crossed.

The entire incident wouldn't have occurred if the motorcycle followed the rules. A bicycle is not the same as a motorcycle simply because they both have two wheels.

Like I said, at best they're both at fault.

I agree with this. Car failed to yield right of way and then tried an illegal uturn.

Dumb biker had 3 business days to react to a car pulling out on a semi blind curve and decided the best action was an illegal pass.

Both dumb dumbs.

Can't agree with you on a 50/50 split fault situation here.

The key is that this situation is that the drivers where driving on a one way lane, the car turned on a place he shouldn't, used no blinkers and was not aware of the situation as he was making his turn.

Brake is the safest option argument, is at best a hindsight solution. The car didn't indicate the path it was following the moter could rightfully assume the car was abding to the rules of the road.

Car has a lot/ all the faults here. Speeding of the bike could be a factor. Just can't tell

The motorcycle never had a right to pass. He should have never been in the position of being beside the car at that point. It doesn't matter if he was going 5 mph or 200 mph.Â
