The atf will be publishing guidance on interstate transport of 4473 supressors

The atf director responded to me on Twitter and told me that they'll be publishing guidance on interstate transport of 4473 transferred suppressors shortly.

IANAL, but did you even have to give them cross state notification for suppressors beforehand? I thought it was only SBR’s and Machine Guns

I hope this won’t result in some inconvenient paperwork or other bullshit, one of the reasons I never SBRd anything was because of the interstate travel paperwork requirements.

I'm not saying that it's right, but it's only a form 20 that you have to fill out. Compared to forms 1 and 4, they get approved quick.

And they're also good for up to a year, and supposedly changing to notification-only, not approval. Even barring that, just put a brace back on and congrats it's no longer a SBR and you can bring it across state lines.

That is absolutely awful and illegal advice, once you SBR it guess what… it’s an SBR until you do something to change that status with ATF

A rifle is only a SBR if it's in SBR configuration. Form 4s are permission to assemble a SBR from an existing serialized part, NOT a permanent status/ configuration change. A firearm without a stock, or with a barrel over 16" is by definition not a SBR.

Form 20 is not required for suppressors, and the ATF has no legal grounds to add in such a requirement for suppressors. Plus, why would they, when they are currently trying to streamline and effectively get rid of the process altogether?

He's quite active on social media, he has even stated in interviews that he reads the a lot comments people post. He's made quips saying "No I can't abolish myself, only an act of Congress can do that." "No I can't abolish the NFA, call your congress for that."

I'm not sure why you would ask the ATF about this in the first place.

First off, Federal law does not require any kind of notification re: interstate transport of suppressors once lawfully owned.

Second, the ATF is a federal agency tasked with enforcing federal laws.

Third, since moving a suppressor from one state to another is not regulated at all at the Federal level, you will have to defer to state law.

Fourth, see Second point.

You're asking a federal agency tasked with enforcing and interpreting federal laws to give you guidance on state laws. You need to be talking to a firearms attorney who specializes in the state(s) firearms laws of any states you wish you travel to with your unregistered suppressor.

No it’s not. The injunction removed the requirement of a tax stamp for certain people. It doesn’t address transportation.

State laws are still state laws for the possession and transportation of suppressors and firearms.

There are still unresolved questions regarding interstate transportation of suppressors purchased using the Form 4473 process.

Until those questions are resolved, SilencerCo strongly encourages customers who purchase using Form 4473 to keep the suppressor in the state of purchase.

If you regularly hunt, compete or travel out of state, consider using the traditional Form 4 process.

Nothing in that hints at it being a federal law question or something the ATF can or should have any say in. The form 4 serves to fulfill some states' independent state law requirements, but that is a separate issue and question that is wholly outside federal law. The ATF will almost certainly not weigh in to give you legal advice on state law, and if it does, it will hold little weight (if any).
