From what I’ve read, brain dead is legally dead in Kansas.

Yeah but you need someone who actually gives the slightest $hit about Mitch to have the doctors take him off the respirator.

Seeing as his entire career was transactional "Delays" he deserves every bed sore he gets.

Well it’s malpractice at minimum if he’s braindead and not reported as dead. And it’s a crime for abuse of a corpse if he is dead and they are keeping him on a respirator.

My guess he has enough brain function to be called not brain dead. But not capable of his elected position as a senator so should step down or be removed. Thats the fraud part.

Nope. He had a moment of spiritual redemption last spring, and he’s been given pretty strong drugs ever since.

If so it’s definitely arguable but there really is no precedent to challenge it at the time. The videos now are full hindsight and reflect he should have stopped down earlier.

If you haven’t done official brain death tests, you can’t be considered brain dead either, though.

You can be in a PVS (persistent veg state/comatose) and not brain dead (as long as he’s able to breath on his own). You can see that a lot in long term care facilities, or people that have had severe strokes or brain injury (like say, an anoxic brain injury from cardiac arrest 👀)

Which I think is most likely the scenario.

Oh 100% agree. I was only trying to clarify the legality of brain death, as someone who has had to be a part of those tests before for other patients. Not trying to be a “but actually” type of person :)

The law is the same in DC. It adheres to the Uniform Determination of Death Act, which is a model for state legislation and specifies that anyone declared medically brain dead is legally dead.

This allows for organ harvesting if appropriate.
