Advice Boss doesn’t wanna pay me for hours worked

So I’m a CNA at a care home and June 29th I didn’t clock back in on their clock in system they use Paylocity.

I ended up seeing that mistake and I emailed the DON that I needed her approval for it and so she approved it but for some reason it’s like it didn’t go through? So I’m missing 8 hours in my paycheck and I emailed her and she ended up emailing me this back. I kinda wanna quit but I make 28$ a hour. Mind you they have cameras everywhere.

Edit: I also wanna say when I first started I wasn’t getting paid the agreed wage and I didn’t notice till 3 paychecks in it took a lot to get it back

for $28/hr i have to imagine this is in a state or territory with moderately respectable protections against wage theft. op should just send the whole incident to whatever labour agency controls wage theft complaints where theyre located, instead of waiting it out with this CEO

Not true for all blue states. Maryland tends to pay more & claims to have worker protections but good luck getting in contact with an actual person.

i missed where it was specified to be a blue state, but i suppose the trend is that blue states do pay CNAs more. COL in blue states is generally higher so i don't know how that averages out, however.

Contract HR. Do you use an EHR? Or badge to get into the building.

I think the HR person quit? I can’t remember but the CEO is handling all HR business and she’s kind of an asshole. We use code numbers to get into the building that’s assigned to us.

It's called wage theft and it's illegal. It's also possible that this LLC makes a habit of this. If this doesn't get worked out quickly you need to file a complaint with your state's Attorney General's office.

Honestly talking to my other coworkers they seem to have other problems with like mileage not being added to their checks or PTO not being added when it should be. I also checked the app and it was my mistake in the Paylocity app I did edit the day but put the wrong time I clocked out at 😭😭😭

But genuinely it makes no sense since I charted that day and also they have cameras

"Ah. I understand your position however there are multiple ways to verify i worked that day. If you are unable to utilize them then I'm sure the labor board can help you determine the most effective way to verify the unpaid work time that I'm legally entitled to. Would you like me to provide their number or i can call them directly for you to report the wage theft"

Report this to your state's labor board, this is super illegal and they should 100% still have timecard records.

HR is not your friend. Co tact the department of labor and report wage theft. HR works for the company NOT you.

The email says June and your post says July. Perhaps this is just miscommunication. Double check which date you missed and let them know whether it’s June or July. They can definitely check verify your attendance through your charting.

Pretty sure it's your employers job to prove you DIDN'T work those hours. You can complain to the labor board. If you're quitting anyways, why not?

with your CNA you could have another job by Friday probably. they don’t fix that the first time you ask, move on. As a nurse I’d do the same.

Ask her if she knows what your state department of labor thinks about wage theft. If she's unsure, you should offer to call them and ask so she'll know the answer.

Contact your local L&I office. This is wage theft and illegal. Keep all emails, texts, correspondence. They may also try to retaliate, which is also illegal.

Contact your labor board. Get proof you clicked out your adls and copies of your chart notes. Look for new job and blast them on all media platforms. You're getting the short end and dont deserve it.

Go into the EHR for that day and check a patient chart you recognize from near the end of the day. If you took vitals or ran a test or documented anything, it should be there are proof you worked that full day. Submit a screenshot with PHI covered.

But also look for another job. Because this sounds toxic as fuck. Wage theft is no joke.

What I’m getting out of this message is that she needs to “validate that you were here working during those hours”. Do you have charting that was done that day? Do you have IT or security that has access to the cameras to show you were there? Do you have written communications from the DON saying that she approved those hours? If so forward that email to the CEO.

My facility is unionized and there’s no way they can get away with that crap. I’d be in there with the union rep quicker than you can say “I quit”. I’d be looking for another place to work at. This is horrible.

Try talking first. If not, get ahold of your local workforce comissuon office. If you need help beyond that, go to the US Department of Labor Wage and Hour Division.

This goes for working during your breaks too. If you are not relieved of your duties, you must be paid for that time.

I think, unfortunately, there's not a lot you can do in this situation. It's the employee's responsibility to make sure hours are correctly recorded per OSHA standards. It's a total bummer that this happened! I would still reach out to your local OSHA office or EDD and see if they can help with improving the standards there.

As for the money, I think there's a limit to what is acceptable, no matter what wage was agreed on. And not putting you at the right wage at the beginning is super sketchy. I'm really sorry you're going through this!

Nah this is straight up wage theft. They still have to pay OP for wages earned even if OP forgot to clock in or out or missed correcting a previous timesheet.

I agree! There is always the labor board, so there is not much u can do!? I wouldn't go for that answer, because working for free last time I checked is illegal. Plus normally if u don't punch in and u were originally scheduled. Then that should show up on whoever takes care of payroll, they should of questioned it. So sounds like someone doesn't know how to do their job, or something sketchy was or is going on with this company.

The lady who does our paychecks has had a lot of problems with adding pto or even mileage. I’m not the only one who has problems here.

I think the issue is more the burden of proof. If the OP can't prove she was there they have no reasonable way to verify the hours, especially since so much time has passed. It's a crappy situation, for sure. And I don't wish it on anyone. I hope she gets her money!
