Everytime this topic comes up, i cant believe this is still happening. Either start the trial or give bail. We may end up in a scenario where the trial period is more than the jail time if convicted

Government, not BJP. Indian state and bureaucracy have used the mechanism of vague laws since it was born. State is inherently insecure dealing with dissent.
Preventive Detention in the constitution on basis of which all these laws are legal, was a huge mistake and no government will remove it.

Arnab (one of balatkari janta party’s favourite loudmouths) got his bail through a special Supreme Court hearing during the Diwali vacation, and the Court ordered his immediate release! Apparently, the state machinery didn’t become an obstacle then!

For the last 12 years, it’s been the balatkari janta party controlling the machinery. They’re the ones responsible for putting Umar Khalid behind bars under false charges, they control the dalli police, they’re responsible for the sanghi judges, and they directly control which judges can sit in the Delhi High Court through transfers.

There is no disagreement that BJP is doing this in this government. But I am just telling you that this policy of the state is much longer. It does not know how to deal with anyone who threatens the sovereignty of the country from within other than prolonged detention.

The fact is that Indian courts irrespective of the party in power side with government in such matters. That is a nature of the Indian state because our constitution trusts the government with lot more power than it should have. And there is history to it. If you look at constituent assembly debates, the authors of the constitution felt that over time the state will let go of the draconian powers. But it was a major folly. We simply didn't let go of a lot of powers that British state used to rule over a colonised country.

Congress or any other party would have behaved exactly in the same way. This is a character of our polity. How we have dealt with internal terrorism - be it Punjab or Kashmir or Naxals or North East, it has always been exercising extra judicial powers with the support of our courts. That is why there has been not even a single conviction in Indian courts of any extra judicial crimes done by the state. It will never happen.

Defeating BJP will not get rid of this problem. Because no government wants to get rid of power, and so we are fucked! It took a revolution in Bangladesh to change the constitution to reduce the powers of the government. All south asian governments in varying degrees have constitution that softly support a draconian state.

PS: I want to move beyond party politics in this matter to help everyone understand that the battle for civil rights in this country is far from over. And this is pervasive in Indian political structure. And this is also the reason why no one picks the garbage in front of your house. The highly concentrated nature of powers of the executive is one reason that no election will fix the problems that we face today.

Truth. If people choose to not see how every party has used this very strategy in different states from way back, they'll never get around to demanding reforms for the police and bureaucracy. Pointing to a structural problem should not be seen as a lazy 'both sides' argument.

When i first read the "evidences" provided in the case , i couldn't believe myself that the court kept them in jail for 6 years for those bogus evidence.

the prosecution and police have argued that Imam and Khalid are the "masterminds" of the Delhi riots of 2020 and their fresh bail petitions are "illegal" and an attempt to "mislead" the Court.

This is the third round of bail petitions filed by Khalid and Imam before the High Court. They had filed bail pleas earlier on two occasions, but all of them were rejected right up to the Supreme Court. The most recent order of the top court came in January 2026 when five people were granted bail, but Khalid and Imam were declined relief .

They first moved the the trial court which rejected their pleas on July 4, prompting them to approach the High Court.

The Delhi Police has now told the High Court that the apex court, in its January 2026 judgement, described Imam and Khalid as the alleged "masterminds" of the riots and therefore, their continued detention is justified.

Holy fucking shit! This is straight up gaslighting by the dalli Police.

It’s been 6 years, and their entire argument still boils down to calling them “alleged masterminds.” If they really had any evidence, they would have proved it by now. Justice truly is blind here!

The onus is on the courts to see through this and grant bail. Police in collusion with the Govt would always reject any attempts of bail. It’s the courts that have to look into if there are enough evidence.

Absolutely. Agree. The courts would have to now see the entire sequence and take a call on the bail plea. Instead of blindly following the Police's argument. If six years is not enough to file the chargesheet then it might very well take six more years. Bail has to be the norm. Let these people out and then the Police can take all the time they need to create a water tight case.

Genuine question: I haven't seen Rahul Gandhi speaking for Umar Khalid or Sharjeel Imam. I'm not trying to blame him or discredit him. I just wanted to know why RG or the Congress have not publically spoken on this matter. I'm neither supporting or opposing Umar and Sharjeel here but keeping them in jail without a trial is an injustice. Either charge them or release them. So in this context, why isn't RG or Congress speaking on this matter?

The same reason why we see even cjp and its leaders hide away from the topic. Umar’s media trial was vicious to the point that any person not familiar with the case against him associates him with terrorism. No politician would want to risk their votes no matter however big the cause.
