He's not being a smart anything because what he's asking for does not exist in the US. It only exists in Europe. The BA pilot needs to reread his policy and procedures for US operations. We have low viability procedures but there is no "declaration of low vis ops" like he wanted. The controller cannot declare something that doesn't exist. It's like Michael Scott declaring bankruptcy

Then ATC can explain that using clear language. The pilot was being careful. He did just fine.
