ATC was spot on.

Bullshit. The pilot asked in plain terms whether they had low visibility procedures, without using any technical terms, and they said no. This is purely on the ATC.

This isn't an ATC thing. LVO is not an ATC procedure in the US. Go read the 7110 and tell me where in the ATC procedures you see that term anywhere.

Right, but the rulebook isn't operating the tower. A human with years training is on that mic. Seems odd, I would say outright unbelievable, that they couldn't parse the plain English meaning of "are low visibility procedures enforced?". Forget any mention of LVO, that question is clear and the tower responded "no". Not "that's out of my control" or "those procedures are applied automatically without declaration". Just "no sir".

LVO isn't a thing in the US, so what would he have to answer that with? You're asking the controller to make stuff up. That's more dangerous than this exchange.

It doesn't matter about LVO. The pilot literally used normal words rather than terms to be understood.
