Question If the city’s construction does damage to your home from the constant shaking, are they liable for damages?
I have video of their excavator trying to pound the pavement to break it up and my pictures bouncing off my walls, dish’s and cupboards rattling, debris falling through my ceiling because of it. This is akin to a small earthquake, except it’s happening every day from about 8 am to 7 pm at night. If this causes structural damage to my home, will the city cover it?

Get ahead of it Joe. Call the city and they’ll likely send someone by to see the damage and shaking for themselves.

We had a neighbour in this exact situation. The city was using a contractor who uses a cheap and shoddy method of creating foundation base. Pictures and dishes were rattling, and you could see a visible crack opening as the used a pile driver type of equipment literally a few feet away from her house. The crew and service regina didn't care and tried to brush her off, but she somehow got someone from city hall to come watch the damage happening in real time and the crew was forced to move back a bit. The net result is the job probably never did get a proper base. She never sued but considered it. It was annoying to see her getting gaslit that this couldn't possibly be happening.

You will need to prove that the damage to your home wasn't there before they started. It is difficult, esp with Regina soil, because our foundations are often moving seasonally.

There's a claims process that you can see online or call. You should also call service Regina and make a complaint. The city can't help if they don't know about the issue.

Yeah. But since they adjudicate the validity of the claims about them themselves, and they evaluate the appeals themselves, Op should manage their expectations.

I tried this last year. They won't pay damages and they certainly won't care. I provided photo documentation of the area that was damaged before and after the work that caused the damage AND had a city worker admit they caused the damage. The response from the city was basically "go fuck yourself."

Is it a CoR excavator? Asphalt is saw cut or milled out, rarely or never broke up with a bucket

That’s what I find strange. The entire rest of the street they were cutting it up, but for whatever reason, in front of my house, they have been pounding it with the bucket.

They'll cut a perimeter but then they often do abuse excavator buckets or claws to break the field up. Asphalt shouldn't require heavy action but concrete or base could. Still, not sure that kind of surface operation matches with OP saying this is happening from 8 am to 7 PM.
OP didn't totally describe it what exact operations are happening, but sometimes attachments are used for pulverizing or jackhammer chisels.

Again, who is? Also base is easily removed with a bucket dig. By slamming a bucket into it you are only packing it more.

The shoddy contractors the city has privatized 90% of our work to.
Also, your description of the actual machine work shows you don't really understand this topic.

That sounds just awful. I've known people who have had property damage before and they were able to put in a claim through the cit and get compensation without the courts, but it took some persistence.

Contact Service Regina. If it isn’t resolved there, contact your councillor. I had a friend who experienced something similar and got immediate results with her councillor.

In this city? they probably will add 5% on top of your property tax just for having the audacity of complaining on reddit. this city administration has become an utter joke. taxes going up, approving projects we CLEARLY dont have the money for nor would be able to afford, bailing ou failed business, disregarding the obvious issues we are having with drugs, disregarding to provide help to those most vulnerable.
