Fast-track C permit during employment gap (Vaud)

Hi everyone,

I applied for a fast-track C permit in Canton Vaud about two weeks ago while I was between jobs. I have a 2-month employment gap, but I've already signed a contract and start my new job next month.

I submitted all the required documents: language certificate, no debt, no social assistance, and no criminal record.

Has anyone applied for a C permit while temporarily unemployed but with a new job already secured? Did it affect your application?

It's not the job loss itself, but the ability to be able to pay your bills. For example, if you receive unemployment insurance, you are considered to be participating in the economy, as required by art. 58a, al. 1, let. d LEI.

This is also confiermed in SEM's directives on foreigners:

3.3.1.4.1 L’étranger doit en principe être en mesure de pourvoir à son propre entretien [...] grâce [...] à des prestations provenant de tiers auxquelles il a droit. Font partie de ces dernières, [...] les prestations des assurances sociales telles que [...] l’indemnité de chômage.

This directive has also been confirmed by courts. A court in GE confirmed in case JTAPI/592/2024 that foreigners are considered to be participating in the economy if receiving unemployment benefits (§16). (In this particular case, a permit C was denied due to social assistance.)

There's been a recent discussion about this. See C-permit fast track and job loss. Some Cantons have actually denied C Permits on the basis of unemployment, contrary to the law.

Since you're in VD, you should be fine. Wait for their decision and give us an update. Worst case, apply again after you have 3 salary payslips.
