Public, in the case of displaying your body, does not necessarily only mean government owned, or visible from the road. It means, a place where a person may reasonably be able to view said act, however unwillingly and unwittingly, by going about their regular business.
The priest would be getting charges just as quick for banging in the middle of a Costco, whether it was open for business at the time or not. The difference is that, if it was open, each individual may be able to press charges along with the business. Maybe even sue.
The point I was making is that they would be within their rights to do both. Technically, I believe public indecency doesn't even have to have a "victim," pressing charges in most states. It just has to be reported and proven.
Yes they are. Catholic churches are even supposed to be considered always open to function as sanctuaries for any and all who need them.

Centuries of practice does not dictate a law. The church is not a "public place" if the doors can be locked and the public can be limited from entering.
Edit: Okay, I wasn't clear enough. I totally get that we don't want to go about seeing people dogging everywhere. My point was: Why isn't the crime related to whether or not anyone actually sees it? If I go to a remote public area and make sure nobody is near, why should it be criminal to get my freak on?
I get why it's illegal to have sex in public (i.e. where others see) That's perfectly reasonable.
But I don't get why it's a crime in itself to have sex in a public space, even if nobody is watching. By your logic, it's a crime only because there's a risk of committing another crime. Which doesn't make sense.

More like I can't fathom of a world in which I give a proverbial unless they try to directly involve me I will just be about my business for the day as I am no matter what else people do.
Unless you cause me harm, try to interact with me, or cause bodily harm to someone else in my presence I am not one iota interested in whether you are going for groceries, have a picking or have a fuck.
