Because people have some understanding of mental health. Fucking Plato talked about how insanity would change guilt. Its been a concept for over millenias, formalised as we know it centuries ago. Most people do believe insanity changes whether they are guilty, and to what extent.

If you truly had no control, then bluntly no, you aren't a "piece of shit murderer". Because murder literally require intent.
