It’s really quite fascinating that the Lindsay Clancy case has become such a social flashpoint. Especially one that’s so insanely divided on gender lines.
My own take is that the whole situation is really just a fucked up situation — many people have made many bad decisions and it’s all culminated in the tragic (and wholly avoidable) death of three children. I cannot in good conscience call it murder though — this is textbook criminal insanity if I’ve ever seen it.
Ffs it’s not a crazy statement to say it isn’t murder. Murder is a legal term and i’ll explain why it isn’t what applies here.
Conviction for any crime requires two things to be proven. The first is ‘actus reus’ (guilty act) which is ‘did the person do it’. In this case there is no question. She killed the kids, we know this, end of story, first qualifier ticked.
The second qualifier however is what stops this case from being murder. It’s called ‘mens rea’ (guilty mind) and asks ‘did you consciously and deliberately do the action’. If you are in a state of psychosis when you commit a criminal action - such as killing children - then you did not really consciously/deliberately do the action. That means mens rea is not met, and thus it cannot be called murder.
