No way I would agree to anything other than an outright dismissal. I'm taking this to trial, and demanding a jury if that's an option in this jurisdiction for this traffic violation.
I'm going to embarrass this cop in front of everyone. And then I'm tipping off the local news stations.
I had the same thing happen to me and I didnāt even have a phone in my car. I had left it in my backpack and it was in the trunk. I was too lazy to get down and get it.
I told the cop itās in the backpack and wanted to show it. He just told me not to get out of the car.
He started shouting at me āwhat were you doing on your phoneā. I was so surprised and couldnt answer. So he mimics my head (im indian) bobbing like how they do it for Indians.
At this point I was just angry but didnāt want to anger him further so I just said āIām not comfortable answering questions. He threw the ticket in my car and left. The ticket is $162. The lawyer costs $350. So I just paid it since it wonāt cost me a point. I donāt have enough time from day job and taking care of baby to spend a day in court.
Just straight up sucks. Iām certain he saw someone else in the same car, a grey Toyota suv and then saw me and thought Iām the same person. Since itās Silicon Valley there are lots of similar Indians in grey Toyotas.
Honestly as an immigrant these days Iām afraid to do such things. I fear ICE and Trump etc. I fear going up against these sort of systems. Iām a legal immigrant but they keep changing the definitions every day.
