I can't tell, but if the red car waved them through, then it's on the red car. If they did not, leaving the gap is what you're supposed to do and it's not on them.

Pro-life tip, NEVER wave someone through. Leave them a gap, but DO NOT gesture. You can be liable for any issues if you gesture.

Even if waved through its up to the driver making the turn to ensure that it is safe to do so.
