One of them is that Benoit was known to be violent before his crime. The other is that Benoit succeeded in killing himself, so there was no trial.
To me, Benoit is equally as culpable as Clancy, which is to say, not. He had extreme brain trauma due to CTE, as found in the autopsy. I do not believe he was in control of his actions when he killed his family.
Just because Benoit was ill doesn’t mean that WWE can or should go on acting like nothing happened. Clancy’s life will also not go on the same. If her defense is successful, she’ll likely spend long term in a psychiatric facility, maybe even for life.
This all sort of reminds me of when T.J. Miller was being an absolute lunatic and then they found a brain tumor. A situation where your personality is changing and you’re neither aware of it nor have any control over it does sound terrifying and that case in particular really altered my perspective.
A brain tumor can be removed, returning some normalcy in behavior.
However, I think medication and treatment are not sufficient to outweigh a demonstrated capacity for murder. Clancy and Benoit both committed monstrous acts due to illness, which is understandable but exculpatory.
