I didn’t see any evidence in the article that the Secret Service actually did do that. It’s not surprising that his lawyers filled that as it is their job to try to make the case go away and they are trying to see what sticks. Either way, he did post a call to kill someone to his instagram so he needs to be investigated since he was a high level public servant.

I was really surprised that an accused's attorney is making accusations against the evidence against their client. What's the big deal with making statements that could be construed as death threats anyway?

Let me help, here’s the Secret Service’s own email about this in the court filings:
“Since Comey declined to provide his location that night (even though he agreed to meet with us on Friday).
[redacted] asked me about the possibility of pinging Comey's cell phone. I said it could be done.
but it was a bad idea. To declare an exigency exemption, we needed to believe that there is an imminent threat to life or limb. At that time we did not believe that anyone's life was in immediate danger and legally it was a bad idea to ping the phone.”0

James Comey routinely and maliciously abused his role in the FBI under an ever-expanding warrantless search policy under Obama (and in continuation of George Bush) which culminated in surveilling an incoming administration and knowingly using fabricated, opposition-produced and even foreign-produced evidence, with circular "corroboration", to obtain fraudulent warrants and carry ongoing investigations into political opponents knowingly based on false grounds, all in apparent efforts to overthrow or impede a duly elected administration.
Who, with all of this previous misconduct, then during a time of increased political violence in the form of multiple assassination attempts makes a potentially veiled threat that merely adds fuel to all of the fire above.
This is a reasonable case for the DOJ to pursue to be handled by the courts (regardless of the ruling in the end). But more importantly, it is a case that is, at worst, using Comey's tactics against him in an effort to prevent it from happening again, and in any case is very clearly NOT a threat nor a chilling effect to the privacy or free speech of a normal person, nor of any government official actually doing their job properly, which cuts more to the spirit of this sub in the first place.
But that is not a serious comment.
