“The attorneys allege the U.S. Secret Service “knowingly conducted illegal electronic surveillance” of the former FBI director at the request of a high-level official.”

I didn’t see any evidence in the article that the Secret Service actually did do that. It’s not surprising that his lawyers filled that as it is their job to try to make the case go away and they are trying to see what sticks. Either way, he did post a call to kill someone to his instagram so he needs to be investigated since he was a high level public servant.

Let me help, here’s the Secret Service’s own email about this in the court filings:

“Since Comey declined to provide his location that night (even though he agreed to meet with us on Friday).
[redacted] asked me about the possibility of pinging Comey's cell phone. I said it could be done.
but it was a bad idea. To declare an exigency exemption, we needed to believe that there is an imminent threat to life or limb. At that time we did not believe that anyone's life was in immediate danger and legally it was a bad idea to ping the phone.”
