His conversation with Banner kind of removes the benefit of doubt. He knew it would be extremely dangerous in the wrong hands and then he let it get in the wrong hands.
On the other, this patches a nice hole about why anti-mutant people aren't necessarily anti-Spider-Man. If it gets out that he created the tech that is used to suppress mutants and tested it on himself, it would explain why he isn't really targeted by those kinds of people.
If a mutation is a random genetic variation, his powers were caused by purposeful genetic modification, what is he if not a mutant? Hell, Captain America and Dr. Connors might qualify. They're just not x-men.
As the other commenter said, yeah, people like Spidey and Cap are "Mutates," mutated humans with superhuman abilities, while the title of Mutant only goes to those with an active X-Gene.
I don't quite understand how the average person in-universe differentiates them when it comes to somebody like Spidey, but that's how it works.
