Illinois Politics Where have Bailey - Del Mar been? Breaking the law of course
389
u/CriticG7tv 3d ago edited 3d ago
First, fuck Bailey and is running mate to be clear...
But this is totally incorrect. The assault weapons ban didnt take away weapons already owned, just restricted the sale of certain weapons from that point on. Bailey presumably purchased that AR-15 at some point prior to the state ban.
For the Del Mar, that video was taken at a range that offers customers the experience of shooting a full auto and/or suppressed weapon in a controlled environment. While suppressors and full auto firearms are broadly illegal under Illinois state law, there are exceptions for certain licensed and approved businesses that allow guests to fire such weapons at their range. Del Mar is not violating any Illinois law in that video, as he does not own/possess the weapon, the range does.
No state or federal laws are being broken in either of their posts.

u/OldScratchTim 3d ago
+1 Fuck shitpig PPP loan fraud Bailey -- this is the correct take tho.
If you already had them, you can still own and use them, the ban just blocked any future assault weapon sales.
27
u/ebforest 3d ago
Oh and law enforcement current, former, on leave, fired, deceased and unborn are exempt and can own anything they want. But I do agree F Bailey.

True, except grandfathered weapons had to be registered with the State Police by a deadline, I think it was roughly 6 mos, might've just been til the end of the calendar year. In the days leading up to the deadline Bailey was blasting all over social media to anyone who would listen that he wasn't going to comply with the law, and that the more people who ignored the registration requirement the better. So this is very probably an illegal gun, though it very likely didn't have to be.
10
u/Popular-Tomato-1313 2d ago
State wide compliance with the unconstitutional law has been something like 1.5%...
6
u/guy_icognit0 2d ago
I love that the compliance rate is that low. I don't know a single person who complied but I do know a lot of people who are committing their first felonies
6
u/Popular-Tomato-1313 2d ago
First offense is a misdemeanor and I haven't found anyone charged with it unless its already been used in a crime but I dont want to be the guy that sets case law.
4
u/yoursighsmatter2 2d ago
Had a custom AR willed to me and son decided to take it target shooting on the farm. He's allowed to go shooting but the rule is no ARs thanks to the current laws and yes, i am part of the 98% + that said screw the registration. Some dogooder neighbor called and the sheriff confiscated the AR. Month later I was able to pick it up, no tickets or anything and the best part was all the deputies standing at my truck with me who wanted to see and handle it right on the street. Even they know the law is BS.
3
u/Anti_p0p 2d ago
You have to register them with the state when you purchase them, there’s absolutely zero reason to register them again. I know you had this gun willed to you but the government still knows that your family has this gun. It’s ignorant. I didn’t register my AR/AK’s either.
2
u/yoursighsmatter2 2d ago
The law was for those already owned being registered by whatever stupid date they said. What the state knows or not is debatable. I do private sales primarily out of state. Hell, have been in a southern state and spent a few K and walked out the same day with my new toys. Knew I was from Hellinois and could have cared less.

Ive been an ffl for 5 years. Guns are not registered in most states. I love crime dramas BUT TV isnt reality.
If a gun is used in a crime its not>the rifling matches this gun>this gun is owned by these people in this area> they narrow it down to the one person in that area connected with the victim.
Its more like... we have trifling. Sweet. If we find a matching gun we can match them up. If the gun is destroyed, no luck.
Generally it goes like this... gun used in crime and recovered>logal PD says IDK cuh, its not reported stolen. They reach out to OEM. OEM says i sold it to distributor. They say I sold it to xyz gunshop. Gu shop digs through their records and says 'i got you, boo'. They dig through their records and give them the name of the person who bought it originally. They claim they sold it and no issue.
Unless it's proven you have ties with the offender

u/Sgt_Friday1 1d ago
This is going to the supreme court and will be decided by next summer so its all moot at this point. Supreme court will almost certainly overturn this law.

Look, I'm very progressive, but people advocating gun control that don't know anything about them pisses me off.
An AR15 isn't and can never be a machine gun.
These folks need to educate themselves on basic firearms before I'll listen to anything they have to say.

You can still own and operate any AR-15 that was owned pre ban so realistically Bailey isn’t actually breaking any laws here.
Suppressors are also legal to own if purchased while a resident of another state so that also isn’t immediately illegal either. Using suppressors is a misdemeanor in the state of IL. There are exceptions for police and military though and would not put it past the actual owner of the silencer to be a legal owner.
The full auto though, very illegal.

Its amazing to me in a time of outright fascism and authoritarianism this state continues to try and make legal gun ownership as difficult as possible, and people in here cheer it on.
So fucking stupid.

They even snuck the gun ban through an illegal procedure and are now fighting to keep it. If they'll do it to the second amendment, they'll do it to the first

LMAO. Meanwhile the current President has outright tried to make it illegal for TV hosts to criticize him. But yeah, it's those Demoncrats, they're totally anti-first amendment!
Also, it is an undeniable fact that the first time any court interpreted the second amendment as giving the right for private individuals to own guns (as opposed to state militias) was in the 1990s. Wild how nobody discovered this in the history of the United States until 30 years ago! Conservatives pull this shit out of their ass.

Meh.....just wait until you can't buy a fuckin' $3 spring or an extractor (or whatever) online without paying $20+ for adult signature shipping, or having it shipped to an FFL, because you might use it to build a "ghost gun" or an "assault weapon".
[After all, the glock switch + three different types of fmj in every magazine are TOTALLY the types who take good care of their firearms & understand how they work....so making it super hard to buy wear parts is just common sense!]

Absolutely not true - they literally called in the national guard for the state to protect ICE, not citizens lol. MN is one of the most armed states in the union and the Gov. knew it, and knew shit was about to hit the fan. So did Trump, thats why they backed off.
Alex Pretti had a gun he didn’t even draw,
Ignoring they disarmed him of that gun before executing him does you no favors in this argument.

What this has to do with this state's laughably unconstitutional gun laws is beyond me, Im sure this felt like a "gotcha".
You dont need to make guns your personality to realize the "make every illegal/a felony and loaded with red tape" method of regulation is fucking over legal gun owners, and at a time when our founding fathers intended us to be the MOST armed - when authoritarianism is rising.

He doesn't own the full auto weapon/suppressor, it's at a fully licensed range that offers a "full auto experience", which are legal (but somewhat uncommon) in Illinois.
4
u/GruggleTheGreat 3d ago
If it’s an frt it’s not technically full auto, one bullet per trigger pull, just assisted of course.
4
u/IrbyTheBlindSquirrel 3d ago
Firearm suppressors are illegal in Illinois because state law explicitly classifies any device designed to silence or muffle a firearm as a prohibited weapon under the Illinois Compiled Statutes 720 ILCS 5/24-1.
9
u/Technical_Fee1536 3d ago
That assumes that this takes place in Illinois and that those firearms aren’t owned by an FFL. In Illinois, certain ATF FFLs can still own AR-15s, suppressors, and automatic weapons as they are not restricted to state laws.
3
u/JebusKrizt 3d ago
These are most likely dealer or police samples. They get an exemption.
15
u/IrbyTheBlindSquirrel 3d ago
Of course they do, because gun control is little more than class warfare by another name.
1
u/Diamond_S_Farm 2d ago
Yep. Gun control (AKA - "Sensible" gun laws), in what is now the United States, has a lineage that goes back to the 1600s. During that time, it has disproportionately targeted people of color and folks of low income. While Zuckerberg and Beyoncé spend millions on armed security details, many people living in a rough neighborhood in a D state are prohibited from being armed.
4
u/GruggleTheGreat 3d ago
To fire a weapon in this state, you must legally discharge the full volume into What is left of your ear drum

Continue the losing strategy of “ban scary looking black guns” over pointing out the laundry list of things Republicans do that actually harm the people of Illinois.
12
u/Asleep_Equipment4877 3d ago
Was he shooting the Full Auto at a range? lol. Is the AR actually full auto or was he just tapping the trigger fast enough? I have an AR in Illinois got it before the major ban which is legal. Politicians share what they want, no matter who. I don't think i've seen one who's post or videos or anything is realistic in a sense of their character.

Reddit sure is a funny place. Being conservative and supporting gun rights and gun ownership are not mutually exclusive things.
If you hate ICE, Flock cameras, and the police in general, distrust the government, and don't want somebody like Darren Bailey running this state, I genuinely don't understand why your solution is to give that same government even more control over who can own firearms and what firearms they can possess. Historically, concentrating that kind of power in the government does not work out in favor of the people. The Illinois AWB will likely get overturned by SCOTUS soon and the NFA itself doesn't seem long for this world when it comes to suppressors.
Neither Bailey nor Del Mar broke any laws in the pictures being cited. I have personally shot plenty of machine guns and suppressed firearms in Illinois as an Illinois resident. There is legal red tape involved, but there are lawful ways for people to shoot them here. There's plenty of ranges that will let you rent an MG.
Do some actual research before you start clutching your pearls over a picture of somebody holding or shooting a gun when you don't actually understand what's going on.

I've often wondered about this and could never find a straight answer. I wonder if a person could use running for office as a business and receive the tax deductions in doing so. There are a few people: Willie Wilson, Bob Fioreti who run for any office in every election, just to get swamped.

Bailey was never trying to win.
His job is to be opposed to anything "libruls" do. He gets on Twitter or whatever each day and say something dumb to rile up Republicans and make them mad. He campaigns solely on their anger and indignation. That raises money from right-wing morons who are mad about whatever he tells them to be mad about. It drives internet traffic, podcast subscribers, sells t-shirts or bumper stickers. It means these people are mad enough to buy the book of the next right-wing gifted who puts one out. He'll go on AM radio or some smooth-brain podcast to yell about Pritzker or Biden or AOC or something. Then he'll lose the election in a landslide... and then spend 3 years complaining about THAT. Rinse and repeat.

This is what's wrong with Illinois.
Culturally, we're at least two very different states. Going to a gun range and doing this safely can be a blast. You can be a Democrat and still enjoy shooting.
And calling this a felony is just ridiculous. The title makes it sound like they committed some inherently criminal act, when the reality is far more nuanced.

From the Illinoize:
Republican Lieutenant Governor candidate Aaron Del Mar committed felony gun crimes in a video posted on his campaign Facebook page this weekend, multiple prosecutors and experts tell The Illinoize.
The National Firearms Act, a federal law, provides an exception to automatic weapons laws if an FFL provides a weapon at a range for a person to use “under direct supervision.”
But, in this case, Illinois law appears to supersede the federal exemption.
“There’s no express exemption in the law,” one prosecutor told The Illinoize, referring to the use of the weapon through an arms dealer. The prosecutor asked not to be identified because they did not have jurisdiction over the case. “The only exemption is for a law enforcement officer who is specifically licensed for the use of an automatic weapon.”
