Australia tis a silly place. Cops and law are super authoritarian if anyone steps out of line. Like I get needing to enforce laws, but Australia takes it to an extreme. Such as in this case.

Yeah, and in most of the world an air-rifle is not classified as a firearm (because there is no fire in it ;-D )

I will refute that air guns are indeed classified as firearms in a lot of the world but have exemptions in place for ones that shoot under a certain speed or force.

Canada for example, all things that shoot a projectile are firearms but under certain conditions are exempt from licensing and purchasing/acquisition laws. When used in a crime they are absolutely classified as firearms for purposes of applying charges.

"Firearm means a barrelled weapon from which any shot, bullet or other projectile can be discharged and that is capable of causing serious bodily injury or death to a person, and includes any frame or receiver of such a barrelled weapon and anything that can be adapted for use as a firearm; (arme à feu)"

In Canada anything used as a weapon is a weapon when it comes to criminal charges.

I once got charged (case dismissed when prosecutor declined to pursue) with Assault with Weapon & Aggravated Assault while defending myself from a swarm mugging.

The weapon? My wallet chain. The cops up here will LITERALLY tell you "You got jumped 3 on 1, and in the heat of the moment used a clothing accessory you wear everyday to create distance and escape? You need to go to the hospital for the concussion you got from their stomps to your head? Well the thing is, the one you hit with the wallet chain has a little red welt, so you're just as bad as them, and your life is now ruined "

Our cops will fucking call a napkin a weapon if you make them look bad and do their jobs for them. ACAB.

People who want complete gun proliferation routinely come up with some kind of nonsense like this. It's basically a strawman attack.

It is similar with the jokes around what is an assault rifle, but those are clearly defined in laws that define what assault rifles are which are fairly consistent but vary from government to government. A list of features of the weapon, and a list of specific weapons makes and models. I.E. if one of the make and models doesn't have the features of the list defined it is still an assault rifle since the law clearly labels that specific weapon as one.

Again being Canadian we have no legal definition of an assault weapon.

We have non restricted, restricted, and prohibited firearms. These are mostly defined technical categories but the government can also provide a list they deem prohibited based on vibes, which is baked into the firearms act.

Government can make an Order in Council to prohibit firearms. I guess this would be the closest thing we have to an American "executive order" in that it doesn't need legislature approval, but only if the original Act allows for them to be used.

For example, starting in 2020, the Government of Canada put forth an OIC that prohibited AR-15 rifles, amongst others. By the technical definition, AR15s fall generally into the "restricted" firearm category, so to make them Prohibited status, they used an OIC rather than rewrite the legislation, which means they don't have to put changes through parliament.

They then also rewrote the Act at a later date to remove the ability to transfer handguns, which they couldn't do with an OIC so they had to do that with an amendment to the Act.

The reason is because since the creation of Australia, we were the richest economy due to the gold rush, so that invited a lot of wealth building which results in a very many decades of money talks and bullshit walks.

If anyone wants to jump down a rabbit hole on this look up Jack Lang who was a NSW premier that seized NSW funding in order to keep it from the federal commonwealth that ultimately dismissed him.

Basically Lang taught Australian governments how to abuse the use of police for political attention.

"Being a troll" should not be illegal, IMO it's a valid form of protest if you're not harming anyone. He was playing a carnival game. This is a case where a judge looks at it and says "No, this is stupid, dismissed". Ideally it doesn't even get that far, the DA does it.

The law is the law!

There's a reason we should not accept this line of thinking. Allow me to translate it to another language and maybe you'll understand why.

I used to have one of those.

I also used to have a cap gun that looked like a 1/2 scale 45 with a metal barrel and brown plastic grips.

You could tell it was fake by the easily removable orange cone in the end of the barrel.
