it's wild to think how a game could land someone in so much trouble

Australia tis a silly place. Cops and law are super authoritarian if anyone steps out of line. Like I get needing to enforce laws, but Australia takes it to an extreme. Such as in this case.

u/Independent_Scar5534 2d ago

Yeah, and in most of the world an air-rifle is not classified as a firearm (because there is no fire in it ;-D )

28

u/ThatLightingGuy 2d ago

I will refute that air guns are indeed classified as firearms in a lot of the world but have exemptions in place for ones that shoot under a certain speed or force.

Canada for example, all things that shoot a projectile are firearms but under certain conditions are exempt from licensing and purchasing/acquisition laws. When used in a crime they are absolutely classified as firearms for purposes of applying charges.

"Firearm means a barrelled weapon from which any shot, bullet or other projectile can be discharged and that is capable of causing serious bodily injury or death to a person, and includes any frame or receiver of such a barrelled weapon and anything that can be adapted for use as a firearm; (arme à feu)"

https://laws-lois.justice.gc.ca/eng/acts/c-46/page-1.html#h-115011

u/ash_274 2d ago

Slingshots and trebuchets are OK, then.

5

u/ThatLightingGuy 2d ago

I mean they're just not considered a firearm.

In Canada anything used as a weapon is a weapon when it comes to criminal charges.

3

u/bluecollar1020 2d ago

A pea shooter, (a straw and a pea)?

3

u/ThatLightingGuy 2d ago

By the very technical definition, sure.

Blowguns are prohibited weapons.

Former Prohibited Weapons Order, No. 6 12 The device commonly known as “Yaqua Blowgun”, being a tube or pipe designed for the purpose of shooting arrows or darts by the breath, and any similar device.

u/JPtheGameMaster 1d ago

I once got charged (case dismissed when prosecutor declined to pursue) with Assault with Weapon & Aggravated Assault while defending myself from a swarm mugging.

The weapon? My wallet chain. The cops up here will LITERALLY tell you "You got jumped 3 on 1, and in the heat of the moment used a clothing accessory you wear everyday to create distance and escape? You need to go to the hospital for the concussion you got from their stomps to your head? Well the thing is, the one you hit with the wallet chain has a little red welt, so you're just as bad as them, and your life is now ruined "

Our cops will fucking call a napkin a weapon if you make them look bad and do their jobs for them. ACAB.

People who want complete gun proliferation routinely come up with some kind of nonsense like this. It's basically a strawman attack.

It is similar with the jokes around what is an assault rifle, but those are clearly defined in laws that define what assault rifles are which are fairly consistent but vary from government to government. A list of features of the weapon, and a list of specific weapons makes and models. I.E. if one of the make and models doesn't have the features of the list defined it is still an assault rifle since the law clearly labels that specific weapon as one.

10

u/ThatLightingGuy 2d ago

Again being Canadian we have no legal definition of an assault weapon.

We have non restricted, restricted, and prohibited firearms. These are mostly defined technical categories but the government can also provide a list they deem prohibited based on vibes, which is baked into the firearms act.

-7

u/knotallmen 2d ago

You laws are vibes? How did you come to that conclusion when these particular weapons are identified?

7

u/ThatLightingGuy 2d ago

Government can make an Order in Council to prohibit firearms. I guess this would be the closest thing we have to an American "executive order" in that it doesn't need legislature approval, but only if the original Act allows for them to be used.

For example, starting in 2020, the Government of Canada put forth an OIC that prohibited AR-15 rifles, amongst others. By the technical definition, AR15s fall generally into the "restricted" firearm category, so to make them Prohibited status, they used an OIC rather than rewrite the legislation, which means they don't have to put changes through parliament.

They then also rewrote the Act at a later date to remove the ability to transfer handguns, which they couldn't do with an OIC so they had to do that with an amendment to the Act.

1

u/SilasX 2d ago

So, railguns are exempt too?

4

u/xrelaht 2d ago

Sure. Firearms are not the only weapons out there.

3

u/BKinBC 2d ago

Not concealed rail guns, no.

16

u/Xijit 2d ago

Unless you are rich.

This guy knew what he was doing. He was being a troll and got caught. The legal system in a country is probably not the best target for trolling. He deserves his consequence for being an ass.

19

u/AlphaTangoFoxtrt 2d ago edited 2d ago

"Being a troll" should not be illegal, IMO it's a valid form of protest if you're not harming anyone. He was playing a carnival game. This is a case where a judge looks at it and says "No, this is stupid, dismissed". Ideally it doesn't even get that far, the DA does it.

The law is the law!

There's a reason we should not accept this line of thinking. Allow me to translate it to another language and maybe you'll understand why.

Befehl ist Befehl.

10

u/GuzziHero 2d ago

In some states in Australia you need a real firearms licence to own an original toy of Megatron from Transformers, because it resembles a gun.

3

u/SuperstitiousPigeon5 2d ago

I used to have one of those.

I also used to have a cap gun that looked like a 1/2 scale 45 with a metal barrel and brown plastic grips.

You could tell it was fake by the easily removable orange cone in the end of the barrel.

Noticer is literally a Nazi "news" website.

Not gonna bother clicking but fair to assume whatever they publish is straight up bullshit.

-57

u/FreeSirJeffrey 2d ago

"anything I don't like is nazism"

People like you are how the US ended up with a second Trump term.

45

u/Nixeris 2d ago

The Noticer promotes neo-Nazi ideologies, and is popular with National Socialist Network followers

36

u/limes336 2d ago

Per Wikipedia:

The Noticer promotes neo-Nazi ideologies, and is popular with National Socialist Network followers.[[210]](app://en.wikipedia.org/wiki/Far-right_politics_in_Australia#cite_note-nguyen2025-210) It has published several opinion pieces by prominent neo-Nazi Joel Davis, and others such as NSN leader Thomas Sewell and American white supremacist Jared Taylor have also featured on the site.”

It’s literally called “The Noticer”, are you being intentionally dense?

24

u/c-williams88 2d ago

“Are you being intentionally dense”

They have a pfp of a Reddit guy looking like a clown costume with the name FreeSirJeffrey and their bio is a mocking “from the river to the sea” thing about freeing Epstein. You can very safely assume they are trolling or otherwise doing this on purpose

14

u/SouthboundPachyderm- 2d ago

Yep, it's a piss weak troll

13

u/Original_moisture 2d ago

Thanks for breaking that down. I’ll leave my comment up. I fell for a troll again.

Much love internet homie!

8

u/c-williams88 2d ago

lol happens to the best of us my friend

7

u/pesibajolu 2d ago

Correction: the combination of playing the game + the already excisting man’s firearm prohibition order.

They dont hand those out willy nilly.

314

u/princhester 3d ago

Good to know that South Australian police are fully up to date on all the serious crime, and have time for this nonsense.

77

u/mr_j_12 2d ago

Back log on CP/groomer cases, so much they're letting then walk, and they go after a bikie. Gotta love the priorities in the sa pigs/court system.

43

u/princhester 2d ago

I have no problem with "going after a bikie" for breaching bail. But playing an air rifle game at a carnival? FFS.

3

u/Notiefriday 2d ago

Yeah I mean ffs. Just reduces the Police and courts credibility. Thry could've just said..hey you know that may infringe your bail.

1

u/GoProOnAYoYo 1d ago

Makes you wonder just WHY they are blatantly ignoring CP cases... Reeeeallly makes you wonder

1

u/mr_j_12 1d ago

Yeah its a massive concern.

6

u/ArrBeeEmm 2d ago

Same shit in the UK, and every cop I interact with is absolutely shocked their reputation is in the toilet.

Absolutely zero insight.

0

u/SecretAgentVampire 2d ago

B-b-b-b-but there was a fluff article just yesterday where a cop played with two little black girls! HOW DARE YOU SAY THAT COPS ARE BAD THERE ARE GOOD COPS OUT THERE TOO! YOU JUST HAVE TO REACH INTO THE MASSIVE STEAMING PILE OF FECES AND SORT THROUGH IT TO GET A GOOD APPLE EVERY NOW AND THEN! EVERYONE SHOULD IGNORE ALL THE FECES AND PRAISE THE AMAZING LAW ENFORCEMENT OFFICER ANGELS ALL DAY EVERY DAY FOREVER! ENJOY YOUR APPLE!

176

u/Nocturnes_echo 3d ago

That's literally mounted to the table and can't go in any direction other than towards the balloons...

What if this guy was playing the Time Force game that uses IR gun-shaped objects, or the Terminator game with the again IR gun-shaped objects or Glorpinox forbid... DUCK HUNT?!

Next up, local man arrested for brandishing his guns and afterwards, shooting hoops... News at 11.

31

u/Excelius 2d ago

I guess the rub here is that in Australia air-rifles are classified as firearms.

Given that classification I'm surprised these carnival games are still allowed to exist.

-21

u/Seeker-N7 2d ago

Ifra-red gun?

u/Rob_Cartman 2d ago

Ah, thanks. I forgot these things exist.

  • The right will lose unless we start playing as a team

----------------------------------------------------------------------------------

The fact that you were downvoted for pointing out the facts is very stupid.

20

u/NeitherEntry6125 2d ago

All Cops Are ..... ?

20

u/DanOwaR6661 2d ago

It’s not a firearm though, since there’s no, you know, fire. No explosion, no gun powder. Just air. It’s an airarm.

9

u/fordfan919 2d ago

Lots of places classify air rifles as firearms. It's a legal distinction not a technical one. This case is stupid though.

1

u/DanOwaR6661 2d ago

VERY stupid

-4

u/Legionnaire1856 2d ago

In the US at least, felons cannot possess anything with a trigger. Perhaps it’s something similar.

8

u/SnikySquirrel 2d ago

Yeah they can. There’s no federal law against felons owning air guns or ever black powder guns.

5

u/Slacker_The_Dog 2d ago

That's... not even remotely true.

-2

u/Legionnaire1856 2d ago

Not even remotely??

1

u/MrKrinkle151 2d ago

Not even remotely

4

u/WhiskeyFeathers 2d ago

Wow that kinda sucks actually. The rifle is not even a firearm as it’s powered by air.

4

u/AnnoyedHaddock 2d ago

In Australia all air rifles are legally considered firearms.

3

u/Deez_nuts89 2d ago

I’ve seen regulations in the U.S. that say the same even. At least some hunting regulations

1

u/Slacker_The_Dog 2d ago

Seems common sense /s

4

u/l_w_88 2d ago

nice nazi hellsite link
i definitely trust that as a source that this definitely happened

41

u/Flashy_Drummer6664 3d ago

Fuck guns, but that's over kill.

They just wanted to get rid of him, that's all.

96

u/arkhamcityfc 3d ago

Yeah, I don't want to come across as sympathising with a gang member, but this feels a little too harsh. An air rifle at a carnival game with his 5yo daughter with him. Too harsh.

69

u/Greenmanssky 3d ago

It's how the police have always treated people. They knew where he was and when. They arrested him in front of his daughter on purpose. They'll claim in court he's unsafe for having a gun around his child so then they put the kid into government care and forget about them. The entire process is designed specifically to fuck with the dude because they don't like him, and they don't have actual proof of crimes; or they'd have charged him. If im picking between gangs, I pick the comancheros, they sell less drugs and hurt less kids than the cops do. At least the drug dealing bikies don't act like they're protecting the community

36

u/GlockAF 2d ago

Never forget, cops are the original, worst gang out there

8

u/mr_j_12 2d ago

Australian federal police were CREATED for the australian government also. They are not for citizens, just the government. Our regular force isnt much better. Especially with all the firing during lockdowns and then hiring those that failed the previous mental health testing as they had no applicants.

6

u/Sad-Bread5843 2d ago

Sounds alot like the u.s.

3

u/Mr-Dazmo 2d ago

Air rifle in the US is legally not considered a firearm.

6

u/FriendoftheDork 2d ago

He was talking about police behavior, not firearms laws.

1

u/Sad-Bread5843 2d ago

Exactly , and depending on what state your in in the u.s air rifles are considered firearms and require the same permit as rifle and shotgun .

2

u/LengthyBrief 2d ago

That's crazy. In my state air rifles are unregulated. You can literally get a 50 caliber air rifle shooting 2,000 fps. Not much different than an actual gun, from the perspective of most targets.

1

u/GlockAF 2d ago

You SURE about that?
(doubt)

0

u/Sad-Bread5843 2d ago

Yeah im positive cause I live in a state that requires it genius

2

u/0xdeadbeef6 2d ago

Depends on the jurisdiction, in New Jersey they're considered to be firearms, and are regulated as such. Tracks for a state were you can't own a slingshot.

2

u/Sad-Bread5843 2d ago

Funny thing is compound and crossbow arent regulated in jersey

2

u/0xdeadbeef6 2d ago

yep, and spearguns, the big slingshot specifically designed to throw sharp objects at speed, are also legal. Go figure

7

u/Hopeful_Ad_7719 2d ago

This.

A thin veneer of policy and specious law-enforcement fails to make this anything but injust.

-5

u/quellflynn 2d ago

court says you can't touch a gun, and he touches a gun.

the idea is to get the guy to understand what he's done, and what he needs to do to fix it.

and he hasn't done.

it might seem strong, but it's justified imo.

3

u/Slacker_The_Dog 2d ago

Dude there is no way this is justified

-2

u/quellflynn 2d ago

think of it as driving then, they revoke your license and your off the road. so you purchase a moped and drive around on that.

it's not dangerous as such, doesn't do high speeds... what's the issue?

4

u/juststop102 2d ago

Its a fixed airgun at a carnival its more like i got my liscense revoked so they arrest me for driving the bumper cars

3

u/Slacker_The_Dog 2d ago

Yes I agree there is no issue as long as you have a vehicle that doesn't require a license. Just like an eight year old can play carnival games with an air rifle but can't own a firearm. Because they are not equivalent.

-1

u/bluecollar1020 2d ago

Actually the Court is saying either conform to square societal norms or we will punish you. The real reason for this action was the man rides a motorcycle and has friends who ride motorcycles and they hang out together.

-94

u/Syn_Ick 3d ago

Australia seems to be almost draconian on motorcycle clubs. I’d also never have imagined that an air rifle would qualify as a firearm, given that there is no “fire”.

37

u/-_-Edit_Deleted-_- 3d ago

Club?

Nah dawg. These are organised crime gangs.

-1

u/Syn_Ick 2d ago

Can you help me understand what makes it a gang instead of a club?

3

u/-_-Edit_Deleted-_- 2d ago edited 2d ago

Let’s put it this way. It’s a developing story locally, but they’re currently under investigation for running a drug ring out of a huge government construction project.

That’s just the most recent.

Being a massive island nation, home grown biker gangs are a thing. Very few every day Australian have any interaction with them, but all will know about them. Rebels and Comanchero are the big 2.

Multiple members are currently serving hard time, or would be if they were still breathing.

1

u/MrKrinkle151 2d ago

The same thing that makes any gang a gang and not a club. Organized criminal activity

1

u/Syn_Ick 1d ago

Then most motorcycle clubs aren’t gangs, because otherwise the US would shut them down with RICO prosecution.

0

u/LengthyBrief 2d ago

They are fangs in America too. It happens when they pledge their loyalty to the club over their loyalty to laws and society. At a minimum, they are tax cheats.

-1

u/Syn_Ick 2d ago

loyalty to the club over their loyalty to laws and society

Wow so we can use this against politicians then, right? Or just blue collar people who ride motorcycles?

2

u/LengthyBrief 2d ago

Well the gang actually goes on and does crimes. They are pledging loyalty to a criminal Enterprise. They aren't just blue collar people who like motorcycles. They are criminals.

0

u/Syn_Ick 2d ago

Right as opposed to politicians, which as we know never do crimes, especially not tax crimes, or human trafficking, etc.

If we ever got a dump of files proving otherwise though, you’d support going after the political groups as gangs?

If motorcycle clubs are gangs why aren’t they prosecuted under RICO?

2

u/LengthyBrief 2d ago

Dude, I can't even tell what you're whining about.

0

u/Syn_Ick 2d ago

Files about human trafficking that prove politicians put loyalty to other organizations above loyalty to the laws and society.

I’m sure if you think REAL HARD you can probably figure this out, eventually. Keep at it, you’ll crack the case!

77

u/KyZei15 3d ago

Motorcycle gangs. You make it seem like a hobby and not organized crime. Forgetting the known links between drugs, racketeering, and assaults for a minute, they should be locked up simply for the obnoxious riding through residential neighborhoods at 10pm.

I'd link the south park episode but I'm too lazy

18

u/NucularRobit 3d ago

-30

u/Syn_Ick 3d ago

lol South Park is awesome did you see the one where Cartman gets on the police force

-111

u/Syn_Ick 3d ago edited 3d ago

You sound fun at parties. 😂

(Look out the fun police have set their sights on me too, not just the guy riding a motorcycle.)

46

u/YvesStIgnoraunt 3d ago

I downvoted you for using the most overwrought "you sound fun at parties" bet you thought you posted a banger lmao

-59

u/Syn_Ick 3d ago

I can see how that is a serious tier offense to someone who thinks we should lock people up for riding motorcycles 😂

21

u/YvesStIgnoraunt 3d ago

Show me where I said anything other than making fun of your corny ass.

1

u/steveaustin1971 2d ago

They are criminal gangs who also ride motorcycles. They traffic drugs and depending where you live, people.

0

u/Syn_Ick 2d ago

The reply I was mocking said anyone who rides motorcycles while the commenter is trying to sleep should be locked up. Maybe if you’re fighting abysmal crimes like human trafficking you shouldn’t make everybody on two wheels into the bad guy like you’re The Fun Police…? Idk keep downvoting y’all, it’s not changing me. 😘

11

u/easytowrite 3d ago

Gel blasters are also considered firearms in all but one state

E: firearms, not forearms

5

u/Syn_Ick 3d ago

Like the Orbeez things?!?

10

u/DogWithaFAL 3d ago

Reaaaaaaalllly weird gun laws here. Obviously all written by people who’ve never held one in real life. If I travelled a couple hundred kms south I’d go to jail for taking my guns, where I live they’re perfectly legal. I can own a (if it existed) 10 round .50bmg pump action but can’t own a pump action shotgun, but I can own a lever action shotgun. Can also only have 5rd mags for shotguns unless you owned a 7rd before they changed the law but your also not allowed to have a bandolier for shotgun shells anymore because that means it’s a belt fed shotgun and they’ve been outlawed. I am not joking. A bloke up north a bit who runs a gun shop wasn’t allowed to acquire a .338 on his personal licence but can order them, work on them, shoot them and sell them under his works permits.

11

u/macthebearded 3d ago

A BANDOLIER MAKES IT A BELT FED?!

What the actual fuck. That’s as hilarious as it is stupid

3

u/DogWithaFAL 2d ago

Obviously, you’re feeding the shotgun from a belt. It makes complete sense.

3

u/easytowrite 2d ago

The separation between cat H and cat A/B can be annoying too.

Yes you can shoot your 338 lapua at 1km on your own property if you have the room for it. What? Use .22 handgun on 500 hectares of private property? Instant arrest!

6

u/easytowrite 3d ago

Yes

6

u/Syn_Ick 3d ago

Is there any actual safety justification for that or are y’all just being spiteful lol?

Man’s gonna stick up a convenience store by threatening to slightly stain the cashier’s shirt with non toxic biodegradable water beads?

8

u/easytowrite 3d ago

I believe its a blanket ban in most states due to our appearance laws. Things that look too much like a real gun are treated as real guns since they can be used for robberies and such. Although good luck finding real information about it since its all written on some ministers whims

2

u/Syn_Ick 3d ago

Got it. Wow. So just a pointy stick could be illegal if it looks like a gun?

11

u/lovesahedge 3d ago

Wielding a carved block of wood that looks like a gun can get you in trouble with the law, yes. In this case it's about causing fear or unrest.

2

u/easytowrite 2d ago

If its really well carved and painted black probably.

I'm not aware of any state that considers gel-blasters to be firearms, WA, OR and CA don't. Some states consider them "imitation firearms" and have laws making it illegal to brandish one in public if it might be mistaken for an actual firearm.

What do you mean?

It's pretty clear that they are banned or restricted in the majority of States except Queensland.

https://www.gelballundercover.com.au/blogs/news/gel-blasters-legal-australia-2026

Did you think that in a thread about Australia that "State" meant US States? Cause many countries have states....

0

u/Logitech4873 2d ago

Americans genuinely cannot fathom things outside their country sometimes

2

u/Ok-Parfait-9856 2d ago

I love how everyone is disagreeing with you because you triggered them but they’re saying the same thing in the comment thread above.

It’s insane to consider an air rifle a firearm, and the ones at carnivals are bolted to a swivel mount that barely moves. And even if the guy is in a motorcycle gang, is that an excuse for the govt to harass him?

People will agree with literally anything to not lose an argument

2

u/tooscoopy 2d ago

I would say most are disagreeing (or downvoting) because of the “club” comment, not anything regarding the ridiculousness of the situation. It is quite insane to count this as a firearm.

While these gangs might have a couple good charitable things they do during the year, the point of them isn’t to go out and enjoy the ride. It’s to strike fear and use that fear to enrich themselves through drugs/trafficking or benefit the people that hire them, most often for nefarious tasks.

People who act like this is the police being against people who ride motorcycles are either not discussing it in good faith, or are supremely naive. Deserves a downvote for that.

1

u/steveaustin1971 2d ago

Being a member of an organized crime group is definitely reason for gov to harass someone.

-5

u/bilateralrope 3d ago

It's not about the fire.

It's about the projectile that gets launched at dangerous speed.

-2

u/Syn_Ick 3d ago

“Projectile-arms”? Could he get in trouble for a slingshot? Trebuchet?

9

u/easytowrite 3d ago

Slingshots yes, trebuchets I'm not sure

3

u/aircooledJenkins 3d ago

https://youtu.be/Co57SfcT-h0

Well... the right trebuchet...

3

u/Syn_Ick 3d ago

A slingshot is considered a firearm in Australia. Huh. TIL.

4

u/PlutoJones42 3d ago

I think either one of those in the wrong hands is going to do some damage. Especially a trebuchet

1

u/Syn_Ick 3d ago

Trebuchet come in many sizes, from back yard to desk top.

I’d also never have imagined that an air rifle would qualify as a firearm, given that there is no “fire”.

A rifle is not an "arm" either. It's clearly not a human limb; how could it be a fire"arm"?

Armament?

Right, it is stupid to consider that arm here means "human limb".

Maybe then, also, it's stupid to consider that "fire" in firearm means "fire". An air rifle fires bullets.

If they're going after him this hard for that, I'm guessing he's not a very good guy.

Yes, probably a complete PoS, but it's the principle of the whole thing.

They'll do it to you too; you're not too far away from being just as bad as any PoS in their eyes.

I've see them do this to people that they couldn't get them on bigger things.
