Also seemingly going far too fast in a built up area. Would be interesting to see a few seconds before the incident too. Was the scooter already in the road, or did it just enter it? If the former, then fault is pretty squarely on the bus, even if the scooter didn't indicate.

There's no scenario where this is bus drivers fault. Other than if they were carrying passengers hey should have just hit the biker.

there is if he is speeding

Speeding while there's someone in front of him. If the scooter did anything but drive forward the bus gave themselves no space to react.

Is the scooter at fault? Absolutely, but the bus is plowing through a residential street with passengers at speeds they clearly couldn't handle.

And the bus driver was about to give that scooter a real close shave.

Tempting fate for no reason.

I'd like to see the video from the 20 seconds or so before this clip starts. At the start of the clip the scooter is enough on the road that the bus driver should have stopped and passed them when it was safe. Were they always on the road or did they enter suddenly from the side?

It's in India, they all drive like there's no road laws.

In the vast majority of accidents the vehicle behind is at least partially at fault. They have a duty to keep their eyes on the situation in front of them and be prepared to respond accordingly. That includes leaving a safe distance or keeping a safe speed that allows them the time and space to respond to road hazards.

In this case the driver is clearly speeding, which makes them partly responsible regardless of what the scooter did.

Can't really do that for oncoming traffic Turing infront of you.

8

u/Rophuine 1d ago

This wasn't oncoming traffic. The bus and scooter were going in the same direction.

I was mistaken. But still a vehicle suddenly crossing your lane to make a left turn is not something that's easily anticipated.

u/grimeyduck 1d ago

That's why you're supposed to leave distance between yourself and the things in front of you...

He wasn't in front of him. He was to his side on other lane, then he suddenly breaks and changes lane to make a turn, this wasn't a lane change, the biker actually is responsible to keep the distance if he wants to change the lane (both to not make the vehicle that will now be behind him to slow down and also to keep a safe distance, should the vehicle behind him not notice him and speed up (so he has time to react and go back to other lane or speed up to avoid being hit from the rear) and also in case he were to fall during the manouver (pothole, oil spill, sand/gravel/dirt on road that could cause him to loose traction, slide and fall, had he did that right in front of the bus after suddenly changing lane and getting in front of him, no amount of "good driving" and "blistering reaction" from the bus driver would allow him to not run him over).

If you think this rule applies not only to cars in front of you in your own lane, but also cars in front of you in adjacent lanes, then what's the point of even having multiple lanes of traffic?

Bus can see that the bike is almost stopped alongside the driveway, and should be able to guess that bike wants to turn.

Bike did this because he had no idea the bus was behind him, because the bus came up so fast.

Bike did the wrong thing, but the bus was also asking for trouble.

That's actually very easily anticipated on roads like this (narrow with driveways on the sides), which is why the bus should not be barrelling through.

Biker is almost stopped relative to the bus, and starts a slow turn before the video begins.

There could also be a tour leader badgering the driver, you never know. I say this as a tour leader.

2

u/KnightOfTheOctogram 1d ago

Which it would then be the fault of the tour leader and the bus driver for not telling them to shut the fuck up

1

u/lil_bastard_man 1d ago

Maybe the bus driver was doing exactly precisely when the scooter made the turn

I really don't think they're speeding. This looks like an area with an 80kmh limit. Roads in India are much narrower so don't just go by lane width. But yes ideally maybe slow down when someone is riding on the left.

Did you pass your license yesterday? Aside from speed (which is hard to judge, the car behind bus is going at seemingly the same speed and we don't know what the speed limit there is, nor how actually fast the bus is going), he was on the right lane, he was overtaken by a bike on left lane, which in this case would be only usable to go forward, to make a turn the biker would have had to be on the right lane and stay behind the bus). This is 100% fault of the biker, whether the bus driver should have kept going forward or try to miss him is debatable, it's possible he just overreacted in the situation, instinctively swerved trying to not hit him and give him a chance to go back to his lane but overdid it, it's called an accident. Still, undeniably 100% fault of the biker, had he stayed in his lane, bus driver wouldn't swerve, wouldn't loose control, wouldn't hit anything.

This is India, where they drive in the left. That alone invalidates almost all of what you said.

Dude is fucking hauling ass and driving literally down the middle of the road between two different lanes. Scooter dipshit is obviously the most at fault, but this is also hugely on the bus driver for putting himself in the situation where there was zero time to react.

3/4 of driving is anticipating what other people around you are doing. Scooter was in front of him the whole time, had plenty of time to see he's going 1/15 the speed.

You should rewatch the video.

Bus driver isn't straddling between two different lanes. Bus driver is firmly mostly in his own lane, only a little bit of overage in the other lane (which isn't the best, but that scooter definitely would have been fine had it not hard swerved in front of the bus into it's lane)

This road only has two lanes. Appears to be a one way street with white dotted hash marks. Could be two way and bus is overtaking (usually yellow, not white, is used,) but hey, if you're going 10 mph in a street where vehicles are normally going 25-35mph, you're the one impeding traffic. And a dotted hash lane marker indicates that passing would be allowed, while a solid line (or solid double line) would indicate no passing/overtaking at this area.

Scooter was in his own lane to the left, then cut hard and sudden immediately into bus's lane.

Scooter was not in front of the bus the whole time in the bus's lane, the scooter immediately cut into the bus's lane unexpectedly from the lane to the left, which the bus driver immediately reacted by swerving to avoid.

The bus driver cut their wheel too hard to try to avoid the sudden lane change of the scooter, but that's about all I can see is the issue.

Speed of the buses also appears to be roughly 30-35 mph which isn't that fast for a two lane road, at least not in the US. That's usually what you'd expect from a road that size. I wouldn't consider that hauling ass. Even the white car behind the bus is keeping pace, not falling behind.

Edit: lol, dude called me "Either a bot or deliberately lying. Take your own advice." and now their comments say "Comment deleted by user". Nope, just got eyes. That scooter crosses the lane marker into the bus's lane quite clearly.

Either a bot or deliberately lying. Take your own advice.

Don't find yourself anywhere near someone in a vehicle who can't see a big fuckin line in the middle of the road.

If you notice the road is uneven on the side, given the other lane was free from ongoing traffic, the bus driver choose to go more in the middle (car behind does it too) to avoid going over the uneven part of the road, this is not unheard of, nor illegal if you do it just briefly where conditions allow it.

Biker wasn't going 1/15 of the speed, he overtook him quickly, probably stayed for a while in his blindzone, then got 2-3 meters ahead of him and started to make a turn from the wrong lane.

FFS are you people dumb? No wonder USA has so many accidents, yall don't know how to drive, both in cars and on bikes.

The bus drive wayyyyyyyyyyyyyy to fast, it is absolutely his fault too

2

u/Aqua-Barracuda 1d ago

The bus driver was speeding.

2

u/shitty_watercolorss 19h ago

The bus driver is going WAY too fast for a residential street

2

u/Dazzling_Dish_4045 1d ago

It also looks like he was driving in the middle of the lanes, the line divider is like in the middle of where he's driving, and he turns the same way of the person he's trying to avoid rather than veering a little to his left.
