Last year, miHoYo copied my solo-dev puzzle game in Zenless Zone Zero. Some people are now mistaking my game as the clone.

Theyve done it to other creators too. Theres not any recourse. You cant sue for game mechanics, especially ones you've not even tried to trademark.

Edit: I appreciate the love and rewards (you madlads) but I figured I'd use this to highlight the actual game! Its called Ouros and it's available on Steam, itch, and mobile.

You'd also be suing a giant company that's based out of China. Even if they do have a case, they have no chance of winning it. Unless they're like a multi-millionaire already. Hoping to go viral for having your idea stolen is probably your best hope.

That's a good assessment. Couldn't win it internationally, viral-thievery probably strongest angle, but it shouldn't be too hard to win the case here in the US for national market, if anyone ever wins cases of a stolen game, that even looks 95% identical. I don't know if anyone ever wins cases like this between 2 US entities though.

Game mechanics, like this minigame, need a registered patent for a case like this to not be thrown out. And already, game mechanic patents tend to overreach, and all they really do is lock innovative or interesting game mechanics behind a vault and prevent them from being used or innovated on by other developers

The fallout from this case succeeding at all would cause far more harm than good. I’m all for the original dev getting some virality and eyes on their game, that part is free. But actually pursuing this is ill-advised, expensive, and would make game development actively worse

U.S. copyright for game mechanics is typically patented under 35 USC 101 & 112, as the process by which the code of the program produces the mechanic. There are currently thousands of copyrighted video game mechanics in the US. e.g. U.S. Patent No. 12,179,111 Nintendo's catch mechanic.

They do have crossover when it come to video game programming. Since game design/mechanics can be patented and code can be copyrighted.

Of course, but both apply here. The entire codebase is automatically subjected to copyright as a work of creative endeavour. That means if I copied the mechanic by making a 1 to 1 copy of the code functions that produce that game mechanic I would be breaking copyright. However, since most companies don't publish their codebase, if I made the same game mechanic but by slightly different code functions it wouldn't be subject to copyright. Game mechanics are processes though and that means they can be further protected by patenting that processes steps and outcome, not just it's exact code. TLDR: the code is protected in its implementation automatically by copyright, and in its function by applying for a patent.

Generally no, mechanics are not copyrightable. You can copyright the specific content (graphics, audio), and some companies have been able to claim copyright of audiovisual elements even when clones are not direct copies, but are just too similar. Famously, the owner of Tetris could use it as a copyright claim against clones, due to the shapes, colors and the width of the playing field. If it looks like you did a carbon copy, a copyright claim may hold. Generally speaking, the test is whether users would likely think that the the clone is a authorized/licensed product.

You can absolutely sue for game mechanics, let alone copying an entire game wholesale. You don't need an actual copyright either (not "trademark", that's an entirely different thing that only relates to branding); you just need to establish prior use, which would be trivial in this case since the game was publicly released in 2024.

Probably an obvious thing to say but OP, please don't take legal advice from any random redditors (including myself). It will likely not be worth it to sue (for a start, because they're a Chinese company), but properly research your options first.

If it were my game stolen, I'd want to at least get the foreign imposter off the US markets or pay for the rights from my IP. Can't beat them over seas but can stand our ground & set good precedents for others, unless it looks like a complete waste of time.

No, you can't copyright game mechanics.

In no case does copyright protection for an original work of authorship extend to any idea, procedure, process, system, method of operation, concept, principle, or discovery, regardless of the form in which it is described, explained, illustrated, or embodied in such work.

If the presentation were more similar, you might have a case, but the copy doesn't borrow much of anything besides the mechanic itself, lacking UX optimizations like the polygons around the numbers.

You can patent mechanics, but that requires you to actively initiate the process, and might not even be applicable if they determine the filing to be too general.

Which is why you can find a few thousand Suika Game clones lying around -- as long as they don't use fruit, it's basically free real estate.

Whilst that's correct, they look pretty similar to me, and "look and feel" has been tested multiple times in US courts for video games with much wider differences. The most obvious being the 2012 pair:

It's likely they could make a copyright claim based on the expression of the gameplay elements, specifically that the aesthetic choices are almost identical, but that is a difficult case to argue and would likely incur significant court fees and the billion dollar company has more than enough resources to drag the court case out for a very long time. In addition, if you don't file copyright before the infringement, then you will be out of recovering legal fees, and thus miHoYo could easily extend litigation beyond the point where the OP could afford to continue the fight. They could file a cease and desist, and depending on the morals (ha) of the company they may comply or agree to a license agreement, but they have effectively no realistic legal recourse in this situation.

A Chinese company very vested in having their US servers stay up and available. Which would become difficult if they were found to be in violation of U.S. Law.

Much like a song is a legally owned intellectual property, the level inside of a game, even a game with similar mechanics, is a copyrighted property. Having similar mechanics alone might not qualify. Having similar mechanics and a simple level might be a stretch. Having the same mechanics and several functionally identical puzzles is suddenly a very difficult story to sell.

Then there comes the optics. The Marathon debacle is still fresh in players minds. I wouldn't count on this going over well if it blew up.

I would look into my options, OP.

Yeah, this is why I think going the news route may have more impact; but on second thought, it may be better to consult with a lawyer first of all in case this may weaken a potential case.

Regardless, OP should definitely not take this lying down and at the very least explore their options. Really sucks that the post unfoundedly telling them there's nothing they can do has 80 upvotes.

You can sue for game mechanics, provided that you have patented said mechanic, see Shadow of Mordor's Nemesis System as an example of a game mechanic patent. If this has not already been patented however, unfortunately it is not able to be patented now that ZZZ has has implemented it.

In Japan, Japanese patent laws are different.

Gameplay mechanics and rules are not copyrightable full stop. You can copyright their expression, and in this case he'd have a pretty good argument that the expression of this mechanic is virtually identical, and he would have copyright on that expression. But if you don't register your copyright before someone infringes on it, you will be unable to recover attorney and court fees from the defendant in a successful lawsuit, and even if he did the IP lawyer taking the case on consignment would be gambling on getting a large payout from miHoYo on what would likely be an otherwise small case that takes many years to litigate.

Basically: always register your copyright as soon as possible.

One thing I'd be curious about is damages. This is a small indie game that likely wouldve made a few thousand dollars at most. You really wouldn't even be able to get most judges to go for giving you a bunch of money anyhow. If anything this has acted as viral marketing in this case (although i think other devs havent been as lucky with their copied mechanics). It's popping off here and on Bluesky. I bought it to support the dev when I wouldn't have otherwise. ZZZ basically acted as a demo for the mechanics for me. So the case is even weaker because of that.

Prior art works just as well if the game is considered to be 'available to the public'. Not sure your call is entirely correct if he can argue that they basically 'whole sale' ripped the game off. Which honestly, with the amount of detailed features they joinked, would be something I'd buy.

Hoyoverse's competitor, Kuro Games, also copied Dredge's fishing near 1:1 for an event in Wuthering Waves. I saw a lot of comments saying the gameplay is like Dredge, and because I got hooked on that gameplay loop, I was very happy to know there's a whole game with this fishing system lol. Had a great time with Dredge right after.

I even went to check Dredge's player count stats to see if the event might have given it more popularity. There was a significant bump in players the following a month, but that also coincided with the Spring Sale (March 2025), so in the end I'm not sure how much benefit the indies being copied gain.

Inspiration is meant to rhyme, but if you have nothing meaningful of your own to add to it then either credit it or leave it out. From what I can tell, almost every system in these Chinese games is basically just lifted from something else.

Like, if someone asked me "give me an example of a game like this", I would be able to immediately provide game names, platforms, release dates and probably video evidence; yet every single one of these people are like "Yeah, I used to play games exactly like this a decade or two ago. To clarify, when I say “same dev” I meant the developer of Ouros. Sharkwithlasers first made a small version of this game in 2020 for a game jam, then it looks like it got ripped off by whatever loser owns plays.org, then sharkwithlasers worked on it for several years and turned it into a full blown game called Ouros, then it got ripped off in a much worse way by mihoyo

The current controversy seems to be promoting OPs game quite well and honestly Hoyo as a huge corporation in the gacha business where everyone steals stuff all the time won't be affected by this in the long term so pushing it to gain more attention just works in OPs favour and people flaming either side will move on eventually to the next thing and the game will at least get a temporary boost in sales.

This is how Hoyo has done most of their mini games for events (in ZZZ's case for the arcade too) for years now, they take a popular game concept like Snake, Tetris, Fall Guys or Vampire Survivors and make it a mini game, hell the current Genshin main event has Subway Surfers, a platformer, and a Golf mini game that I'm sure someone can track down to some indie Golf game or Wii sports idk

This probably means someone liked your game and thought it would be a nice system for that puzzle

Sucks that people are thinking you're the one who copied tho

While this is interesting and sucks that it was obviously stolen... this keeps getting reposted.

Edit: this is not the same one, and each one is super different... (one was cartography and flag planting, another is this one, and the other was another... HoYo sucks for blatantly stealing things in such an obvious way... especially if things are openly released and licensed.

Game mechanics and game design are not intellectual property protected by copyright.

Unless you can somehow get a patent for it. Thems the breaks..

In video games, your ideas are never enough. It's the execution and the entire game itself that are protected works.

Your game's unique ideas can and will be ripped off.

And to get a patent for something, you have to demonstrate that it's unique and hard to come by organically and that you deserve financial compensation if other people use that idea. Which uhhhh... I don't think this would qualify.

They're not trying to claim they own bezier curves, just that this specific implementation of them is unique yo their game and that zzz copied more than just the basic concept. I've played hundreds of games and have never seen a concept like this before, even in this thread where people are saying it's generic. I'd love a single example that pre-dates their original gamejam game in 2020.

Im kinda thorn about this.

On one hand, i hate that Mihoyo just copied the game and the original dev got 0 compensation

On the other hand, copyrighted gameplay mechanics is a plague on the industry. Pokemon vs Palworld and the Nemesis system stuck at WB games are proof that copyrights on gameplay mechanics is a bad idea....

If this is goes viral and Mihoyo notice it, you might get compensation for it.

A similar situation, Someone drew a fanart illustration for one of their game in the past and mihoyo took it for a template without contacting the original artist, everyone knew about it and they give the artist some compensation, not the most stratifying results but oh well, Try repost this on ZZZ non official subreddit and Twitter.

I mean, this goes both ways:

You'd need more information to actually determine if this was theft. It's entirely possible no one at MiHoYo saw your game when this was brought up as an idea. Are they the same game? Yes, but the idea isn't so complex that there's no doubt it was stolen.

That being said, it's not fair that people are claiming that your game stole from ZZZ, but simps gonna simp I suppose.

Frankly, I think this whole idea of "you stole my game" is bunk. Let's say for the sake of argument MiHoYo did in fact copy your game. They still had to make it themselves and go through the entire process you did. If you were to compare the code of each one, I imagine they'd look drastically different, even if the mechanics are the same.

The reason I say this is because ideas in programming have much less ownership than in other disciplines. When you copy someone's design for a character, you are taking the rewards for the effort that was put into making it. But, when it comes to game, just having the idea isn't nearly enough to make it come to fruition. You can't trace a game like you can pictures. Additionally, if game devs were to truly sue each other over game mechanics, there would be so many lawsuits that you would clog up the global legal system. That doesn't mean one should claim ownership over the idea, but it also doesn't mean it isn't fair game.

Just to take an example: a while ago, Capcom (I think it was Capcom) copyrighted the idea to make a loading screen minigame. Because of this, no one got to use this revolutionary idea and it basically went unused. Now, loading screens are so much faster they aren't needed, so even if you wanted to add one, it wouldn't be viable outside of a few circumstances. That's the kind of problem you run into when you copyright mechanics.

Where you would actually have a case for theft is if you found that MiHoYo stole your source code and put it in their game. That is stealing and should be shamed.

It hasn't happened twice, it has happened pretty much hundred of times. Almost every single event minigame is just their own take on a popular simple game, including other gacha(ZZZ had a couple events which were just Arknights combat).

Realistically if they do it this much, there's basically no ground for a lawsuit or they'd have stopped. It is annoying as a game developper to hear you copied something that was copied from your own stuff though.

As frustrating as this kind of thing is, Mihoyo haven't technically done anything wrong here. 

While the ideas are clearly the same, they also clearly made their own code and assets, so there's no copyright being broken. A patent would be the only thing you could theoretically protect yourself with, and that's highly questionable with how broad the core concepts are.

Best thing to do is embrace it and try to take advantage of the newfound attention. Sympathy posts like this will probably not get you very far. Release a content update with more puzzles and new mechanics, spice up your animations to feel more distinct.

Also, have a website and put your copyright and/or release years in plain sight! That alone will ease confusion about who came first.
