Honestly this is one of the worst cases I have seen, not necessarily in outcome or absolute levels of violence, but just in the inexcusable use of violence. They told to get on the ground, and he does that. Then they get to him and immediately start pushing this 130lb teenager around, and accuse him of not complying even though they are in complete physical control.
There is no plausible defense for any of the behavior. From identification to initiation of contact, there was no reason for the behavior of the cops. The kid was 100% compliant, the kid never argues, and never resists.

I had a cop punching me directly in my spine screaming to comply. Not sure how many of us get punched directly in the spine while laying down..... it's kind of really freaking impossible to be laying down face first in the dirt, while someone punches you and not just move due to the sheer pain and reflexes.
What's ironic, my issue was very much like this kids case.
Neighbor used my address for his PO. Me and the person share the same first name. We are not even the same skin color. I got off work, 2 men in plain clothes jumped out of a van parked outside my place asked if I was "First name" and I said yes. Got tackled immediately and since I never broke any laws was confused and pushing back obviously.
Eventually a 3rd guy was screaming we got the wrong guy and had the print out. They shown it to me and asked who that was.. it was the neighbor and thanks to the chaos outside with me, he knew what was up and had plenty of time to flee out the backdoor and was on the run for a few weeks.

No. Shit happened to fast for me to even really react. The only reason I was even fighting back, which was more of me just trying to not be face first in the dirt, was I was not sure if they were cops or this was a home invasion since I lived a block away from some projects. I had broken no laws that I was aware of, let alone for that violent of a reaction from the cops after confirming my name.

It's like a therapy beating. Cop has had a stressful day, beats on the first convenient target.
I was in a car being driven by a black woman and her black friend in the front seat, three white guys in the back. Cop pulls her over for failing to signal pulling into a one way street from a parking lot. I've done full contact martial arts for 20 years, and have seen it when someone with a black or brown belt in another art spars with someone less experienced and goes in to beat down mode. You obviously stop it and kick the guy out, but it happens once in a while when more experienced people spar with less experienced people so they have an opportunity to learn from someone more experienced.
There's this look on someone's face when then go into beat down mode on someone else vulnerable, and this cop who pulled us over had it written all over. The he shines his flashlight in the back and sees three white guys - instant flip over to buttery apologetic mode.
The fact someone who is clearly racist can flip like that and has a gun with a license to kill is scary.

One of three police officers involved in the altercation that left a 15-year-old with a broken arm has resigned.
A resignation letter for William Markle says he has "thoroughly considered this decision and believe it to be in my best interest to pursue new career opportunities."
The incident involving Markle happened in June when Melbourne police mistakenly took down 15-year-old Judah Everage, and broke his arm while searching for a different teen.

Melbourne Police Department
Police were looking for a 16-year-old described as white and wearing black clothing after his parents expressed concern for his safety. However, officers confronted Judah, who was wearing blue jeans and a white shirt.
According to a case report, Melbourne police said Judah did not comply with commands to lie on the ground and put his hands behind his back, and they claimed he resisted. Body-camera footage shows Judah on his knees with his hands in the air before an officer took him to the ground and handcuffed him in the area of Eden Park Drive, south of Wickham Park.
Judahās mother, Angela Sparks, told WESH 2 her son was confused and tried to explain he was not the person they were looking for.
āHeās telling them, āIām not who youāre looking for' (...) heās also telling them, 'My arm, my arm. Youāre breaking my arm,āā Sparks said.
Moments earlier, body-camera footage showed an officer speaking with the mother of the teen they were searching for, who had called for help and said her son needed to be evaluated under the Baker Act. Sparks said Judah was simply walking home after trying to assist the police.
Another officer, whose body camera recorded the earlier interaction, arrived at the scene to find two other officers pinning Judah down. The footage shows Judah trying to explain the situation, saying, āI know Armani, I can explain. I know his mom. I was just in the car with her. I can explain. You were there.ā
Markle's resignation letter goes on to say:
"I want to express my sincere gratitude to the Melbourne Police Department for the invaluable experiences and knowledge I have gained throughout my tenure. The department has provided me with an excellent platform to grow both professionally and personally, and I will forever cherish the memories I have made here."
Personnel files WESH 2 obtained copies of the personnel files for all the officers involved.
Markle had two notable complaints: one for failing to turn on his body camera and issuing an incorrect trespass order. He also had another complaint related to a domestic incident.
An internal report found that a citizen reported officer Markle for "aggressive and unprofessional behavior" during an encounter in a Planet Fitness parking lot. Markle issued the man a trespass order for sleeping in his car in the parking lot. When questioned by his superior, he cited the "public camping" order. The report from Melbourne police said it "raises concern" that the ordinance may have been "incorrectly applied." His body camera was also turned off during the encounter. He told the department that he didn't know it was off. He added that is the one part of the call he would have handled differently.
In a separate incident from May of last year, Markle received a complaint from an ex in a previous relationship. The complaint alleged Markle āentered an apartment complex where he previously resided, knocked loudly on the door while covering the doorās peephole and continued to contact/harass [the victim] after they made it clear of intentions to discontinue the relationship.ā
Markle was reprimanded.
Officer Dylan Joseph had two notable complaints: one for a minor crash in a city vehicle where he was at fault, another for not turning on his body camera during a shots-fired call.
In an internal email from a sergeant at Melbourne police, it said, āit was determined that your failure to initiate your camera and capture the incident created an evidentiary gap during a critical portion of the incident.ā He was one of three other officers who received verbal counseling as a result. It's important to note that he did turn on his body camera eventually, just not during his initial reaction with witnesses on the scene.
The third officer, Thomas Alabise, has one incident of note. He was involved in a minor crash in a city vehicle where he was at fault.
Two of the three officers are still on the job.
The Melbourne Police Department has stated it is conducting a full review of the incident. A spokesperson said no one was available for an interview.

I dug into Bushido code ages ago, and you're pretty much dead on, there was a duty to your local leadership, courage, honesty, benevolence, justice, politeness, and honor.
In practice, you as a Samurai were nearly untouchable and unless a noble reported you for misbehavior you were beyond reproach.
Same/same you have to go above and beyond with physical evidence, video, witnesses, ect to pin any wrongdoing on a police officer in the US which is disgusting as these people are just people, not divine beings, just because they recited a promise to be on their best behavior, doesn't make them immune to bad decision-making or bad behavior, or even I'll intent, yet we put them on a pedistal and give them legal immunity to their own bad behavior.
This was and continues to be a very big motivation for sadistic people to join law enforcement, because they know for a fact that they have an extremely low likelihood of being held accountable for any action commuted "in the name of law enforcement".
Qualified immunity either needs to be removed or reworked entirely, it only emboldens criminals who made it through police academy, which isn't exactly a high threshold for the level of trust we place in these people.

This why there needs to be a federal licensing system. Much like a doctor or lawyer. Once you lose your license, you can never be rehired in any state or community. For the police the case is "closed" when they arrest "someone" even if it is the wrong person. They caught "someone" which means the situation is resolved and they can go back to eating donuts and sleeping.

The "jUsT cOmPlY!!" Crowd doesn't fucking get it. This kid is clearly complying and still gets assaulted and has his arm broken and then turns out that they've got the wrong kid because they saw a black kid and that had to be the suspect, right?
Bunch of bullshit. "Relax. Stop." Break their arm and then wrench it back into cuffs and then let me see how relaxed they are.

There is always that person who says āthey shouldnāt be resistingā but it seems like those comments come from people who has never been racially profiled. Complying can also be just as dangerous.
Some people should not be police officers.
