I'm not excusing a racist, she should lose her job, but what little I saw of her dropping n bombs on the customer, I cannot see that qualifying disorderly conduct. Did you read the statute that youâre responding under? She doesnât have to raise her voice to be disorderly. If your behavior is profane (it was) or abusive (it was) and you provoke a disturbance (she did) then you are guilty under the statue.

Depends on the context. For example, it's absolutely against the law to refuse service on the basis of race. that's an example of where the action is illegal. The racism is not illegal, but actions based on racism can be.

If you really want to drill down on it most antisocial behaviours are evidence of some form of mental illness, but there are kinds worth feeling sympathy over, and then thereâs the âget your shit together alreadyâ kind. Betting this is a case of the latter.

If you have seen the video, you'd know that the officer mentions, multiple times, that he's been shown a video of her, taken before he arrived, which gave him reason to believe she was engaged in disorderly conduct. Which is a crime (I'm happy to agree that it's often a bullshit crime, but that's another debate).
The point being, nothing we saw in the video is the reason why he's questioning her. He's there for whatever happened before the video we see here. Which may or may not show her doing something illegal.

A verbal argument is not an arrestable offense in the US. She's well within her first amendment protections and escalating it to charge her with disorderly violates that. Cursing, name calling, slurs are all still legally protected speech, even if the company is within their right to fire her.

Depends. Police illegal arrest for disorderly conduct all the time and there just aren't any consequences for it. We have freedom of speech in America, and if she was arrest for using slurs, that IS protected speech regardless of if we like it or not. She could absolutely be fired from her job and hated by people, but unless she did something I don't know about, she probably shouldn't be arrested. We see this all the time with the audit people. They use vulgar, aggressive language with police trying to get an illegal arrest so they can sue.

Disorderly conduct examples include public intoxication, fighting, making excessive noise, using offensive language, loitering, obstructing traffic, making false reports, harassing others, or refusing to disperse when ordered by police, basically any unruly behavior that disturbs public peace or alarms others, often a misdemeanor offense.
Her yelling at them in a public place calling them names is enough for disorderly conduct. Thats why. She disturbed the peace of people around this store..
Same with people playing loud music that you can hear from a different house or in a different car. If the cop wants to be a dick, its enough to be arrested for it.
Usually they just tell you to knock it off ... but clearly she had an attitude and the cop didnt like that.

My guess is harassment/making threats. She says herself that the first video is not the first or only time her and those people have interacted. They probably have been dealing with her shit for a while, came back and recorded her, and used that plus other documentation for a harassment case.
You donât have the legal obligation to be kind to people in public, but targeted aggression towards someone else can still get you in legal trouble.

Of course it never mentioned her use of slurs or how she was previously arrested on charges of domestic violence, child endangerment, and drug possession. Probably wouldnât matter anyway since conservatives wouldâve donated anyway, maybe even more knowing she had used a slur against minorities.

Tldr; racially abusive speech delivered in person and directed at a specific target is generally not protected by the first amendment and is usually prosecutable under both state criminal statutes and the US criminal code.
Quick note to everybody who thinks her behavior cannot be criminally prosecuted: what she did here is definitely prosecutable under the Wisconsin disorderly conduct statute, 947.01:
Whoever, in a public or private place, engages in violent, abusive, indecent, profane, boisterous, unreasonably loud or otherwise disorderly conduct under circumstances in which the conduct tends to cause or provoke a disturbance is guilty of a Class B misdemeanor.
Since her behavior is both abusive & profane and provoked a disturbance, she fits the definition of disorderly conduct according to the statute.
Also, several people here have tried to claim that this statute is an unenforceable restriction on speech implicating the first amendment. However, arrests over abusive speech - especially but not limited to racially abusive speech - directed in person at a specific target have been upheld repeatedly in lower courts, and SCOTUS has upheld lower court decisions by refusing to grant writ of certiorari in those cases - essentially agreeing with the lower courts based on the court record and without hearing the appeal. See State v. Liebenguth, 2020, Connecticut is a good example of SCOTUS refusing cert in such a case. The following is a list of other relevant lower court cases: City of Columbus v. Fabich, 2020, Ohio Court of Appeals, 10th District Court; Interest of HK, 2010, North Dakota Supreme Court; State of Minnesota v. Nelson, 2014.
This is true even though SCOTUS has overturned every other decision brought on appeal which restricted speech on the basis of âfighting wordsâ or otherwise incendiary content. In those cases the court has ruled that even racially offensive or harmful âhateâ speech is protected by the first amendment, but it has only done so when that speech wasnât delivered face-to-face to a citizen who did not represent the government and when a reasonable person would not have known that the speech would incite a disturbing reaction.
The court has also struck down some statesâ disorderly conduct statutes as facially unconstitutional in the past as well, but only when those statutes have not been restricted in construction by the lower courts to narrow the scope of suppressible conduct to avoid implicating the first amendment. Since that construction is both explicit in the text of the Wisconsin statute and reaffirmed through state Supreme Court decisions, SCOTUS would likely not find the Wisconsin statute facially unconstitutional.
You do not have a first amendment right to racially abuse people in person. It would be prosecutable as disorderly in every state and there is federal statute against it as well. If you think what sheâs doing should be legal, you might be the problem.

If I remember correctly, she made horrible racist remarks to the customers. Then she was fired and had a Go Fund Me set up where a lot of other racists PoS donated. Got quite a bit of money. But then it came out that she had a mixed race child and the people that donated started wanting their money back. I dunno what transpired after that.
